Alcohol prohibited from trucks during down time?

Technically you could have problems from a nitpicker officer for just having regular mouthwash in your cab! Since it contains alcohol, and kids and abusers have been known to drink it. There is alcohol free mouthwash on the market, but sometimes it's hard to find.

It seems that people are trying to prove a point that can not be agreed on by everyone in this forum. It's like trying to tell someone who is an alcoholic that they have a problem. Can't help those who don't want to be helped. The only ones that are going to be finding out the truth of this matter is the ones DOT is hauling away. "Why me, why me." I wonder if we can have a volunteer for a sting. The volunteer will be in his/truck with a beer in hand in the back of the sleeper watching TV or playing cards. The lucky individual will have the authorities called for a possible DUI and we can watch.

For a trucker to be DUI it takes a BAC of .04 not 4.0 think about it!
If found with any level of alcohol your busted period!
.04 is like less than a thimble full. -

Though, to be fair, your numbers are correct.. .04 and .08.
On the other hand, it's more than possible to "blow" a .039 or lower. So, you CAN drink and not be legally drunk. You just won't get a lot of enjoyment out of it, I imagine. Probably one ounce of alcohol every two hours or so.
Back in my drinking days, I know exactly how far that would have flown!
Alternatively, get lucky and not get stopped/tested until your BAC has come down. Of course, that's hard to plan...or rather, it's hard to make that plan actually work.

Well, comes down to the end result. If your the guy in the sleeper that was arrested by the time you go to court to get it resolved your out of a job because the company you work for probably fired you. If not your one luck ####### and not sure about you but I would rather not take that chance at all.

and to add: My CDL is the MOST important thing I own! It's my livelihood! With out it I'm just another card puncher making $7-$8 an hour! AND stuck at the house! I like my beer but it can wait till I get home! Or I'm at one of many friends I know around the country that have a house or apartment! Why take a chance??

I just remembered when they came out with a "no alcohol rule" a few years back. It stated NO ALCOHOL of any kind unless it was a legal documented load in/on the trailer! The cops with no brains and fat arses were busting drivers who had rubbing alcohol and mouth wash in the truck! It didn't last long before the ATA of all people fought to get the rules relaxed a little!
I wish the member who is a DOT officer here in The Truckers Report would chime in because I don't want to have to go through the FMCR site to find the rule!
