I need a lawyer that will read one paragraph of the agreement and talk to me for 5 minutes.
I'm so far I have either gotten voicemail or I've been told I need to give them a $2,500 retainer.
So it is not looking like it is going to go in Dino's favor.
At this point I'm leaning toward just getting it off the truck unless I can find a lawyer that will reasonably give me some advice.
But they're going to have to send me something (a rate con) for me to redeliver it and I guess when they do I'll just put on my charges on it.
I don't particularly care if they agree or not and then I'll have to try to find a lawyer and see what they think my odds are being able to collect that or maybe they'll do it on a contingency because at that point it's going to be several thousand dollars.
At this point it isn't even about money. It's just about them being so ignorant and they they want to treat you like you are an idiot and you do not know any better.
If I had a second trailer though, positively that would just sit.Vitkouski, Gearjammin' Penguin, God prefers Diesels and 2 others Thank this. -
Care to name the broker(after all of this is done)?
Dave_in_AZ, Dino soar, JonJon78 and 3 others Thank this. -
Dino, I know what you are going through, but I am going to tell you what the real problem is for you, you are tying up that truck on this single issue, you need to cut loose the load and get the truck moving.
so if I was you, first thing I would do is come to an agreement with the broker to arrange delivery. Get a contact for the person who he talked to.
During the discussion about the agreement for delivery, break out the charges, everything you can prove and make sure he says yes.
Even if you don’t get a rate con, do it through text or email. If he wants it to be billed separately, so be it.
once it is delivered, then bill the broker.
Don’t wait, send it out as soon as you can.
Then follow it up with a phone call to confirm that he got it, have him look at it and ask him to repeat the amount.
now here is the hard part, as mentioned you may not get the money or partial amount.
The broker can and has for me claimed that was all that the consignee would pay which doesn’t matter to me.
what does matter is what he agreed to and I have sued over an amount less than $50 plus legal fees and won.
There has been a bunch of times when I lost money and just had it written off of my taxes as a bad debt.Speed_Drums, Vitkouski, Dave_in_AZ and 1 other person Thank this. -

Well here is the update.
The broker did not call me this morning and I did not call them and we begin our game of chicken.
At about 1 he calls me. I don't answer. He sends me an email and he sends me a rate con. Well it's for the original delivery and there is money there for storage and redelivery but it's really not enough.
Now at this point I wasn't born yesterday and the smart thing is to take it. So I figure you know what it's 1 in the afternoon we have the rest of the day I'm going to negotiate with them but I still have the intention that I will take it. Hopefully I can get more but if not I will take it.
So I tell him that's not enough money but I can do it for this amount which is significantly higher, with me thinking they will come back and counter or they will just say you know what we really can't do any more than we already offered you.
Instead they stop communicating. Ok.
So instead of them simply saying will offer you this much or we can only do it for the amount that we offered, this idiot, when he gets back to me after 5, starts telling me how he's being so fair with me and I just want outrageous money and I'm holding his Freight hostage and blah blah blah.
Now this idiot just has a way of trying to push me and trying to bully me and doing it in a way that completely insults my intelligence and it sets me off. So again, instead of just sticking to a dollar figure this guy starts telling me how fair he's being with me and how unreasonable that I am.
So in the email with the rate con he outlines what the fees are for and he has $200 for redelivery.
So I said to him you have a trucking company. There's nowhere on this Earth that your Trucking Company redelivers anything for $200. Don't insult my intelligence. You know that's the truth so stop the stupidity. And you also know that you do not charge for loads that you have to Store $200 a day.
So he writes back to me we always charge $200 for redelivery. In fact for storage on reefer trailers we charge $200 and that's more than you should get for a dryvan and you know we're being really fair with you you're just being outrageous with your prices and you're trying to hold our freight hostage... and I write back to him and say STOP! I don't want to hear it.
No one moves a full size tractor trailer with 45,000 lb in the Box anywhere for $200. If you want to pay your carrier's cheap rates that's your business but don't try to push me and make me accept that that's normal because it's not normal and I do not accept it! You know that you don't do that you know your company has never done that and you know your company doesn't let reefers run 24 hours a day for $200 you know that.
Well now this guy is just completely off of the rates and he starts going on and on and on and on and on that they've tried to be fair with me but I'm just unreasonable and I don't want to deliver the load and I'm just trying to abuse holding the load to rape them on money... things to that effect.
Mind you my goal was to the accept the rate if I couldn't get what I wanted.
But this guy kept pushing me and pushing me and pushing me and trying to distort reality that little tiny meager minimal amounts of money are magnificent and and wonderful and that's what they do with their Trucking Company all the time and the guy is basically insulting me and telling me I'm unreasonable and outrageous and carrying on blah blah blah
So finally I say I'm done. It's like 5:30 at night all your bosses are gone nothing's going to get resolved forget delivering the load tomorrow it's over. I do not want to speak with you again I want to deal with someone else. I promise you if I do not have an a hole that is trying to tell me outrageously ridiculous things and push me and bully me, in one day we will agree and that Freight will be delivered.
Well the next call is going to be from our claims department because there's going to be a claim. Great let me talk to them because if it's a reasonable human being guess what in a small conversation we will agree and the load will be delivered!
So finally I say to him I do not want to speak to you again. I do not want to hear from you again. You have bullied me and pushed me and tried to get me to deliver that free for free, you have tried to bully me and push me to deliver it for a minimal amount of money, you have tried to bully me and push me and tell me you're going to pay me after the fact, and you have tried to bully me and push me by insulting my intelligence that a full size tractor trailer with 45,000 lb in the Box is profitable to deliver for $200? You are insane!
Then he tried to email me again and I said look, I'm done with you. I am telling you clearly in this email do not contact me again. I will be more than happy to work with another person that is that your company and we will resolve this and get the load delivered, but I do not ever want to hear from you again.
If I do hear from you again I am going to call the authorities and I am going to file charges against you for harassment. Do you understand me? Do not contact me again!
And like I said the hell of it is I wanted to take what they were offering me, but this idiot is just a complete and total idiot and this company, they must take carriers especially with the accessories and just pay them crumbs and think that they're doing them a favor.
And I've said this through the whole thing. This really isn't about the money. This is about that a whole pushing me and bullying me and trying to insult my intelligence in a way that is beyond offensive.
@Ridgeline it's correct. I don't know how to get ahold of the person and do all that that he's talking about but he's correct the load needs to go I need to get it out of here and get back to work.
But this guy is such an effing a hole, I had no choice but to do that.
I may try to find someone else to mediate and get between this and try to work this out before this goes any further.
And I will try that law office as suggested.
Tomorrow's another day...RocketScott and God prefers Diesels Thank this. -
Jesus, if I had a reefer, I'd loan it to you in a heartbeat just to see this through.
Dave_in_AZ, Dino soar and RocketScott Thank this. -
