If they put some thing on your DAC by all means refute it. Put in there that they were forcing you to run illegal and that you left the load IN THEIR YARD.

You might also let your former DM know that if they try to black ball you that you will inform FMCSA and DOT about their illegal activities.

Thank you Brickman. That's by far the best advice.

You have our sympathy but this is something wannabes have to think about going into it . You have obligations to do your job and if you don't do it they will have no problem finding someone else to do it ?
Why are you so worried about your DAC ? Do you think if you get another job something similar won't happen ?
Do you realize if you turn them in for running illegally and an audit is done you also can be charged ?

RickG- I never planned on leaving the truck and the load on the yard. I got a call from my torn wife in the hospital this morning. The first thing on my mind was her. Not the load. The industry should be a little more considerate regarding this type of matter. My wife MISCARRIED! I've have had a great track record with my loads being in on time. I don't want my future in trucking to be ruined because of this. DAC is everything. IF I do report them, I'll suffer the consequences.

Don't worry about it dude. When you apply at another company , just be upfront with them and tell them the deal, before they ask. Most companies know about the bad ones. I've been out here for over 35 years and believe me, the good companies don't rely on DAC because they know it's a joke. Good luck. Take care of your family. Believe me when I say, You get out of life what you put into it.

No accident has happened. A good lawyer will be able to get him off of that.

Why would you dispute it? You quit under a load. I am sorry for your family situation but there was a much better way to handle it. You could have taken emergency leave to tend to family and then resigned later. You admit you took a loaded trailer into a terminal and then you called and quit. They would not be lying if they put that on your DAC. You will be lying if you dispute it. Next time think your action out before you do it.

Obviously you haven't worked for very many ***hole companies (90% of the trucking industry). They don't care about your situation, and to ask for emergency leave is a joke.

You're right . Most companies don't care . There are plenty of wannabes out there without family obligations . Things happen when drivers re far from home and even with the best of companies you're not going to be able to drop everything and go running home .
It's good to give a high priority to family but someone with such strong priority will never make it OTR .
As far as being "forced " to run illegally for 3 months goes , that's BS . Say no , get documentation , and deal with the consequences .

I truly feel for ya with your wife man. But seeing firsthand the company side of it, I understand the dilemma for them. If they can't repower that load, the customer may fine them for having it there late, or may quit using them. I hauled a load of cars from Ohio to Atlanta a few weeks ago. Pay was excellant, but if for any reason whatsoever the load was not at the auction at 6am on Tuesday, my boss was to pay a $10,000 fine to the dealership that hired him, as well as transport the cars back to Ohio on his dime, plus return the money he had gotten to move them in the first place. All in all, between losing the load money, the fine, and not being able to backhaul another load, about $16000 right out of his pocket. That could snowball fast as well. Had there been a similar deal on the other end needing their cars brought up in a hurry.....you see where this is going.
Yes, you have a bigger need then most to get home, but dropping everything and calling them as you are already on your way home will not fly in otr trucking. And if you did it once, you will probably do it again.

    Poobah and Lonesome Thank this.
