    Please explain how a 3rd party auditor will be blamed for discovering discrepancies. This squarely falls on the companies compliance officer.

    I commend you for caring ... but.. If your gonna dance you gota pay the band... my opinion is.. if you falsify logs knowing your doing so better be ready to pay the price... if you do it unknowing so because somebody told or taught you that way .. well then it suck's to be stupid .. If you were told to do so by your company or boss .. and you knew it was wrong .. well again thats on you ..
    IF I was you I would bring a box with me to work tomorrow rake everything of mine of the desk top and draws turn in my key to the executive bathroom and head for the nearest exit ..
    Cause you aren't gonna fix that mess even if you have a truck load of Lucky Charms
    Thats a train wreak in the making and they made you the Engineer

    Stand up , be a man. Write up a memo, send it to all drivers and managers that things like this won’t be tolerated any longer.
    Up here in Saskatchewan a few years ago we had a driver sent to prison for eight years. What I’ve learned since, in the end it’s the driver that pays the price with their freedom for the company to make a few extra dollars.

    I’m not trying to be a smart###. But you’re a Compliance Consultant? You should know the answers. They’re obviously trying to clean things up as much as possible. Maybe hired you a little too late. The audits purpose is to ensure the Carrier is Policing itself, by staying Compliant. That includes any Driver's actions that aren’t Compliant. The old saying that the Driver always gets the blame, is true. In the Carriers case, Drivers should have been given notice of said violations, along with a warning of future violations being met with disciplinary actions. Like a 3 day suspension, followed by longer suspension and eventually resulting in being fired, if continued. In this case sounds like the Company’s the real problem. Usually is, but can’t be proven. It’s all going to depend on the records. Minor vague things might get a suggestion, or warning. Other blatant violations may result in a fine. Either way, they need to comply, next audit will be checking on the warnings or violations. Second time, big fines. The Drivers aren’t in any way going to be fined. The Company’s responsible for their actions. The Driver only needs to be Compliant while in the field, while working. The DOT can fine him at roadside. Not later during an Audit. Get their records in order. Less may be better, in their case. So many “Safety” Departments are a joke. Only worried about the Companies Record looking Legal. Meanwhile they allow Dispatch to abuse Drivers. The Left hands not supposed to know what the Right hands doing. Driver gets the blame from Safety, or Gets bad Treatment from Dispatch, if they don’t play along. It’s Ultimately the Company’s responsibility regardless, of who’s at fault. You play, you possibly get caught and pay.

    Well, that's pretty intense. Problem that I'm stuck with is it's the company that's having the drivers do this in the drivers or just going along with it. So I'm assuming the fine applies to both the company and the drivers?

    I greatly appreciate your honesty and your response. I am definitely looking for another job and I do want to get the hell out of this because honestly I don't think that I can provide any help to turn the company around and I don't want it falling on my shoulders. I would love to stay in DOT compliance but there's not much available right now so I may just have to get out of it temporarily just to find another job. In the meantime while I'm searching and applying I'm doing the best that I can to try to come up with options for them to see what they're doing and to make a change, but yeah I don't think that's going to happen.

    So the motor carrier company hired the company I work for to oversee their safety and DOT compliance. The company themselves do not actually have a compliance officer, that's technically who I am. I do more than just find discrepancies and guide them too being compliant, I actually run their whole show as a consultant. I know that doesn't make sense but that's how it was marketed and that's how I am supposed to handle the job. Honestly when I started the job everything was great and it sounded perfect until I started seeing some of the discrepancies and the issues and then realized how little I have control over the stuff, though I don't really want control and I want to pass it on so that way it's not all in my shoulders, I don't see that being the case in the end.

    I plan on going directly to upper Management with my findings but I really need to get all my data together and that's why I'm hoping to get an idea of the repercussions if they were caught running things the way they are. I believe the way this company sees things is they'll see it more in the financial aspect that if I can indicate to them how this will impact their company financially that hopefully it might help them open their eyes and change, but I don't have all the information and that's why I was reaching out in this forum. Does anybody know where to find this data as to what to expect in consequences and repercussions if they were to get audited and have this found out? If I can get all this data at least a guesstimate anyway I am better prepared to go to upper management in the right way to address it.
