Exactly, hence the last sentence of my last post. Speeding is speeding, running a red light is running a red light, etc, no matter what vehicle you are in. BUT, a DUI is .04 in a commercial vehicle (that is Federal law and applies to cmv only) and .08 in a personal vehicle.

Just curious...
If those who say .04 is all vehicles are wrong, then unfortunately people could of had another drink or two before driving their POV. No big loss in my opinion.
If those who say .04 is only when your in a CMV are wrong and someone drives their POV with a .06 and lose their CDL and job, That is a big deal in my opinon.
I would be very careful in stating any information that if I were wrong would mean the loss of someones CDL and job.
I would also be very careful in adhearing to anyones statements that put my CDL and job at risk.Gearjammin' Penguin Thanks this. -

Have not found one yet that does not have two laws. POV and CMV. CDL is not a cdl for dui in a pov. -
It's real simple people. When you get a CDL ANY amount of alcohol in your blood is to much to drive. When you get that CDL you are now a professional and will be held to a higher standard. Everything you do whether it's in you POV or CMV reflects on that CDL.

Now there are companies that will terminate you for having .02......
I have worked for companies that would terminate you for taking heart medications......

i rarely dont agree with you, but you are wrong on this one.......trust me....at least as far as the state of montana is concerned
.08 in a 4 wheeler, .04 in a CMV...any in a CMV will get you OS
dont ask how i know, but it involved a deep discussion with an officer and a free ride.....charges were later reduced due to insuffient evidence -

But we're talking interpretation of the rule correct?
I know of situations where drivers have been pulled by the CHP and arrested for blowing .04 in their pov...off duty......
If you ever get pulled over in Cali in your 4-wheeler and show the trooper your CDL....he will also ask you to surrender your medical card....
As a CDL holder.... CMV or POV.....you are in the spot-light...
That's why I never drink on my 10 off...nor on a reset...away from home..
I drink adult beverages at home.....and if I do say drink at a restaurant or at the in-laws....the wife drives home.....
My CDL is far more important than my pride....... -

i try not to get pulled over in cali....after i got "felony" stopped in ontario for driving a new pickup on the gravel shoulder (hey i had to try out the 4 wheel drive, and they wouldnt let me take it to deep creek)
i dont booze and cruise anymore either.....i learned the lesson along time ago
but for agruments sake (cali craziness non-withstanding) the laws reads .08 in a POV, .04 in a CMV
.04 will not get a CDL holder a dui, unless they try to give them a persay (the new "light" dui) -

Little brother got nailed for that in a parking lot and spent the night in Newport Beach city lock-up.... He blew an .04......
