So you're saying that they want the driver to honor the contract. That they signed. Gotcha.

The person signed a contract with Hirschback. They can leave but need to pay the price.

Be pretty stupid to train someone just to immediately quit to go elsewhere.

Expecting the money Hirschbach is owed to be paid is one thing, expecting indefinite indentured servitude is quite another.

Driver has two options. Pay for the school they got or stay for the agreed timeframe. Obviously said driver is doing neither. So they are the one in the wrong.

So please get real on the indefinite indentured service. LOL

I think we can safely say that the sharpest legal knives don't work for trucking companies, or apparently use spell check.

If this was about Hirschback getting paid for their training, this is a debt matter. They're going about this in a way that virtually guarantees that they won't be paid. Therefore, it seems logical they really don't care if they get paid. They view the driver as property.

I was looking at going to work for a third party oil hauler in the Permian Basin and in the application it had a Non Compete Clause that said "due to proprietary information I could learn" if I left them, I couldn't haul oil for any of their competitors in a two hundred mile radius for two years. I promptly told them to go get ####ed, in that same language, and they backed off it immediately. Went to work somewhere else.

Another oil hauling company I worked for had a Press Release Clause they wanted me to sign that allowed them to use my image for any reason whatsoever, for perpetuity, even if I left the company. Told the HR lady that I was there to haul oil and not to be a representative of their company in the press. Said that I would negotiate with her about buying my likeness rights if she wanted but they wouldn't come for free and it most certainly wouldn't be for forever. She left it alone and the clause wasn't signed.
