Shipper griped about securement, threatened to remove the load..

    Sure that's the way we all understand it to be. Lawyers on the other hand, they'll go for anybody who has money, if that's the shipper and they sent it out the door improperly secured they're fair game.

    if somebody wiped out a loved one of mine because they were to stupid to strap the load of lumber correctly..
    1st thing I'd do is hire Dwey Cheatem & Howe and let them go after everybody from the carrier to the shipper to right down to the logger that cut the tree maybe even the chainsaw manufacturer
    Cause somebody is gonna pay

    Sometimes I’m really glad I don’t have to operate under litigation lottery rules like you folk down there. If I add 1 US jurisdiction on my Prorate my insurance would double, and I’m sure ambulance chasers are a big part of that. Courts here rarely allow class action suits, and a lawyer can’t act until they’re under retainer. We get a certain amount of protection from that. You people seem to be at the mercy of every lawyer in the country as soon as you leave your house.

    They do have their place I will admit. The stupid mega million payouts you see them getting for single vehicle accidents are just outrageous though. There honestly needs to be a cap of no more than 100% over the medical bills. We've become entirely too sue happy as a nation. "My clumsy ### fell down, somebody has to pay" is our new motto it seems.

    i wouldve told him to take it off the trailer then... tough #### you dont like my securement, you dont own my truck or pay my bills... what the hell does a forklift douche know about securement anyways?

    i dont agree...freight falling off trailer is 100% drivers responsibility... it may be the shippers freight but its not their responsibility what happens to it once it leaves their property..

    I mean your not wrong. Maybe im baised but our legal system has gone bonkers honestly. It is honestly more set up to be a business then a legal system anymore anf instead of facts and logic is more based off fee fees and fees.

    Once the BOL is signed, the freight is owned by you and your insurance company. It's not the shipper's responsibility, nor is it any of his ####ING business. It literally no longer belongs to him.

    This has always been my understanding, and I'm happy to change my mind if I'm wrong.

    Yeah, but the average driver doesn't have anything of value if you're hunting for a million dollar payday, and good luck getting more than what they paid for out of the companies insurance.
