I don't intend to try and get a trailer without an inspection sticker with illegal aliens inside to test your theory. :) The violation is reason to cause more scrutiny that can back up an OOS order, and the violation is all that is needed to put the vehicle and driver into the next level of inspection, as you are aware of, can happen anytime you're inspected and things don't pan out, that they can expand the inspection level as they progress. Why chance it?

You have good points but as previously mentioned, there is no law that specifies a lack of current inspection is punishable by OOS. Your argument on the extra scrutiny is par for the course. An officer is looking for OOS issues no matter what so it's a moot point.

The officer can do an inspection at will and find OOS violations. A current annual will not prevent that

Fortunately, I've never tested the theory, as mentioned time and again, I don't drive equipment that is not up to snuff, administratively or mechanically. :) I have, however, been complemented on my butttight (can't use the other word) attention to detail when I have had inspections. :)

I've been on both sides of it as a company driver as well as an owner operator. I've learned to avoid scale houses and DOT at all costs. I refuse to be their piggy bank.
