There is one small point I would like to make here. There is no way I would make a conditional job offer until after I had complied with 391.23. Based on my reading and understanding of 391.23 it is NOT possible to go through the hiring process and the old employer does NOT know. This information is required by FMCSA rules to be made part of the driver's qualification files.
On a more personal note. The FMCSA is not what it was 20 years ago. They are tightening up on these investigations. I suggest getting this old mindset OUT of your minds and learning these rules. 391.23 is NOT optional on a hiring carrier. The drug clearinghouse is just a small part of it all.
Again, I am not trying to start something. Just reminding EVERYBODY that in today's world it is almost impossible for a hiring company to make a job offer until they have made contact with a present or past employer. I happen to be a motor carrier now and there's nothing in the regs that says I must verify current employment at a particular time. It says something to the effect that I must use due diligence. I can legally check all previous employment and save the current employer for last after an offer has been accepted. There's plenty of other ways I can pull this off as well but I won't be blasting them on a public site.
