Need dot consultant? Dot advice

    I don't miss having to deal with this crap any more. Usually when I come off the road I lean towards going back. Not this time. I am tired of all the crap that goes along with this way of living.

    I can't see how even the Barney Fife wannabe leo's can take themselves seriously, I mean its got to where you have to cheat and lie to even run legal I guess, because if some hand gets lost and drives the wrong way and then has to reverse direction and this leo dyke gets his log book and runs the pro miles against it, he is gonna come out with to much time invested insuch a short trip.. :biggrin_2556: I mean this chick could not stand the thought of giving truck drivers 5 minutes too update their logbook when she pulls them over or they pull up on the scale.. :biggrin_2555: That kind of mentality is what I can't stand about this, it just seems like they are trying to catch you with your pants down so bad, but you're not really even fooling around or nothing , you're just needing to take a piss..

    But if crap like that is gonna save some lives out on the highway, I'm all for it, but I'm not convinced that updating your logbook while driving down the road is gonna save shat.. And if somebody has to die when I blowby the scales, then I guess I'd rather stop and wait on someone to hit me in the gashole on I40 in that case..

    So feel safe now while motoring in Tennessee at least, because life threatening situations like those are being dealt with and causing truckers like me to hire expensive lawyers and pay steep fines and court cost.. :biggrin_25514:

    Why didn't she get all your paperwork while she was at the truck on the initail contact? Well this is what I do. I ask for each item. I don't leave the truck until I get them. If the driver says he cant find the log book, I stay there until he either 1) finds it or 2) can not locate it. If he can not give it to me after a reasonable time, it is then a write up and OOS. You have to give a reasonable amount of time in my opinion. Plus I tell the driver if I leave and you can not produce it after it's been 15 minutes or however long I have waited, I take it that you don't have a log book. Most guys will either say "I have it but it's behind or I'm over my hours." I can deal with that, and since the guys honest I'll cut him a break. What I don't like is the liar types, that bring it back to me 30 minutes later and say "here's my book." Sure it is, after you have redone the thing.

    I'm confused that she writes you up for "No log Book" and "false record of duty status." I'm with you on that one. How do you have both. Plus I agree with your explanation of construction. The falsification of a log book, I always look for where a driver is cheating hours, or shaving
    hours in an attempt to conceal hours driver, either to hide a hours violation or give him more hours on his 70. Never heard of writing up a false for taking too much time between stops. How did it go in court? I'm curious.

    I think she was expecting to write me a big overweight ticket and after shutting the scales down to come after me and investing two hours of her time and 13 hours of mine she tried to make it worth her while.. The court date isn't till next month, I'll post up what happens.. I don't see how she expects to prove her case, getting cited for three of the worst violations possible all on the same ticket is pretty #### viscous anyway.. :biggrin_2556:

    But she really did me a big favor in adding individual notes out beside each offense on her examination report, because seperately the details of each violation makes the others impossible.. :biggrin_25526:

    This kind of BS really sux for drivers because now no matter what happens its gonna cost me considerably, and this woman don't even have to show up to defend this mess if she don't feel like it, and if it gets thrown out completely she probably couldn't care less..
    I appreciate real officers and try to support what they are doing, because they are needed, but there seems to be alot of the same going on, with some truckers too, with their additude they need to be working at a carwash somewhere.. :biggrin_25510:

    Got a question for you: I have a tri-axle hauling logs local..I have recently put apportioned plates on it. I know it used to be if you stayed in a 100 mile radius there was no need for a log book. My acc. has just told me that havin the truck license app. I can be odited for logs even if it stays within a 100 mile radius and never crosses the state line.. Is this so? I was also told if I donot cross state lines and record milage out of my home state, my app. license will be pulled.. Any info on this?? Thanks

    question for motor carrier inspector from ny - How often does the dot at the scales ask a driver to look inside the truck, and can they look inside luggage,etc. ?

    I remember reading about a couple of Mexicans that were charged with drug possession and claimed there was no justification for a search . The court ruled it wasn't a "search" . It was an inspection . The officer had the right to check the bunk to see if it had restraints . He didn't see any and saw the drugs when he moved the mattress looking for restraints .

    I say a big "amen" to that! After 47 years, I finally decided that there was life after trucking. In the last 3 or 4 years, I got inspected more times than all the other years put together and it is only going to get worse, especially with CSA2010.


    I informed the company that I was driving for that I would never violate "again" and from that point, up to the day I resigned, the supervisor harassed me every chance he got and I finally just "walked off".

    It ain't worth the risk, take a look at the link below and see. The driver was a former co-worker with me and I don't know if he was running in violation or not, but you can bet your ### that the lawyers are going to find out.
