Well that seems conclusive. There's a database.

Then it is my understanding that if a driver said that he has sleep apnea during last year's DOT Physical, and if the driver goes to a different clinic to get this year's DOT Physical with a different medical examiner, and if the driver tells the medical examiner on this year's DOT Physical that he has NEVER had sleep apnea, the medical examiner won't have any way of knowing that the driver is lying, and the driver won't be required to show the medical examiner that he has been in compliance with using a CPAP machine. Is my understanding correct?

There's a database, but the database seems to be unable to prevent drivers from lying during a DOT Physical because the medical examiners cannot access the previous year's DOT Physicals without the driver's permission. Or that's my understanding anyway.

This is the right answer. @Ridgeline is correct and knows more than most here.

There is a database. They will know if you're lying and exams are not covered under HIPAA. Its federal law.

It's also illegal to lie on a DOT Physical.

As far as doctor shopping, if you go to get a physical and for some reason you are not happy with the results, you can get a second opinion. But you need to give the 2nd doc the same info as the first one. The first one will have entered your info into the FMCSA's database. So will the second and if the FMCSA see a problem they can stop you from driving.

If the medical examiner cannot access a previous year's DOT Physical without the driver's permission, then how will the medical examiner know whether or not the driver is lying if the driver does not give the medical examiner permission to look at the previous year's DOT Physical?

It's illegal to drive one mile an hour over the speed limit too.

You aren't understanding. They don't need the driver's permission to access previous exams. HIPAA laws do not apply to DOT physicals. If you go for a physical the doctor is required by FEDERAL LAW to access the database to see what you put on there before.
