OS/OW Permit FAQs
Either way, in my experience, if it's over the edge of the trailer, it's OS, and it runs with flags and banners, and it charged accordingly. Since most loads that matched that criteria that I drove, needed permits which the company got and I had to read them, I'll agree with you that a banner isn't required until it's 10 feet wide, however, flagging is still required and at night, marker lights are required.

Had to buy those enroute one time just for that reason, so the pictures he shows are still in violation, and after reading more of the posts, it appears he went into AR and TX the same way and both have similar flagging requirements as they also limit width to 8'6", as do most all the lower 48 states. I have never driven a load over the edge without at least flags according to the permits requirements, so I have to agree with Gliding ProStar that the driver is not legal, and hence Hall of Shame candidate.

I’m being a bit of a devil’s advocate here (I don’t really have anything better to do at the moment LOL), but going back to my earlier comment... from the angle of the photo it sure looks like the two units would have fit entirely on the trailer if turned sideways, which also would have better distributed the weight, so if I’m correct on that account then it is still worthy of the hall of shame, in my opinion. Unless there is a good reason for facing them this way that I am missing.
Going off the rule of thumb that most stake pockets are 2 feet apart, then that would be 8 feet right there.
