Written “warning” worse than citation?

    I was overweight at a scale 5 miles from being loaded. The inspector gave me a level 2 inspection and told me to fix it and come inside.

    I thought all would be ok as I passed the walk around and my logs were good and I would just get fined but then instead of giving me a fine she gave me a written “warning”. She also then claimed I was falsifying my logs which I wasn’t. There is no citation on the inspection but the violation is 392.2W which is overweight. This is worse than just the fine right? Is it going to go on my PSP? I noticed it does not carry CSA points but I got screwed didn’t I? Nothing I could really do she was extremely aggressive the entire time to ask for just the fine.

    It’s my understanding overweight tickets have nothing to do with your CSA or PSP points, as it is not a moving violation. I got a driving award in Indiana a few years back for goin 62 in a 55 and it was just a warning. I was thrilled until I called my boss and he said that’s worse than a ticket; you can’t fight a warning.

    Generally yes a violation on a CVSA inspection report is worse in some ways than a citation. A citation can be fought, while a violation for the most part cannot be.
    You happened to get the violation that doesn't matter though. Overweight violations don't go on the CSA score. I'm not positive about PSP but I doubt it slso.

    I wouldn’t sweat the overweight warning. But I’m curious what the basis was for the log falsification accusation.

    She claimed there were pings when I was off duty showing I was moving since she transferred my logs using the web service option. I said I can’t move my truck off duty it immediately goes to the driveline and I don’t know why that would be. She eventually let it go.

    Overweight ticket don’t affect anything. Just a fine, I’ve had plenty.

    That’s the issue it is not an overweight ticket it is an inspection violation. I did not get a fine but a violation from on a level 2 inspection.

    So this will show on my PSP report right?
