yes that is the exception you are correct, perhaps if the question was more detailed, it was a general question, so i gave general answer. No need to be a wise guy

Last month I left my job, driving for BIG DADDY EXPRESS out of chicago. This guy had dangerous equipment,I was there 3 weeks.I reported his equipment to DOT;I recieved a call from them the next day( giving more dates an locations). This guy doesnt have his own yrd, instead he uses different locations to park his equipment.I sure he's told the dot that the trucks are out on the road. How can The DOT inspect the equipment,If the owner keeps lying about the where-a-bouts of it?

What is it that makes his equipment dangerous? Why not just ask a DOT officer to inspect it when you go through a scale??......I'm getting the impression, by what you wrote, that you think DOT inspections is a mandatory thing....Kinda like a inspection sticker, but there not. As long as the truck is not pulled over or stopped in a scale by a DOT officer, the truck can operate for 1yr before it has to be inspected, and even then it doesnt have to be a DOT officer. Or thats how it works in my state anyway.

I am in the HSE dept for an oil field supply company. We have over 200 power units on the road, and we have been ticketed for the following:
In a 70 hour period, (8day) we hauled exclusively to the oil well sites. (Frac Sand), when we do this, we are eligible for a 24 hour re-start, then, start a new 70...However, if in the 70 we do several oil well site deliveries, the do a "plant to plant" transfer, we do a 34 hour re-start at the end of the 70.
Now the Texas DOT is saying we have to take a 34 hour re-start BEFORE we can even do the plant to plant? Is this right?
I drove for 20 years, and have been in management and now HSE for the last 7, and no-one can answer this question in a fashion that is understandable, or in most cases, at all!!!! Help!

You could challenge the violations using a DataQ Challenge. You would have to prove the exception applied. You may consider carrying the exception in the vehicles to offer to the DPS.

If you haven't done so already you should have an account on the FMCSA's Portal to monitor your roadsides and perform DataQ Challenges all from one location.

    Be safe.

I work for a small septic service and most of our trucks are under CDL. I was asked to make sure we are up to regulations, one thing I haven't been able to find out for sure. Are first aid kits required?
