    In a lot of courts, with the help of a lawyer you can plead down to some zero-points thing like having a broken speedometer, but end up paying a fine at least twice what your speeding ticket would've cost. Expect to pay the better part of $1000 to keep your license safe.....

    This is why I phrased my comment in comment #5 the way I did. It happens as you correctly stated, but it is against DOT rules to treat a CDL holder this way.

    After I wrote my last comment I had a bite of dinner took a shower and got ready for bed. After I got in bed I started to think about something an FMCSA auditor told me about this topic. What a lot of people don't fully know or understand is Parts 350 and 384. I asked this person about masking. This is what they said. Maybe 1% of all prosecutors across the country are even aware of 384.226 and maybe as many Judges. They rid their dockets of cases and take in revenue from the guilty pleas. In other words, these people are not even aware they are violating USDOT rules. The same rules they agree to follow to be paid for the inspections that get turned into the FMCSA.

    Take a careful look at this publication. It is a guide prepared by prosecutors for prosecutors when it comes to compliance with USDOT rules. I suggest paying close attention to the last section on page 3.

    In closing, I agree that courts all over the USA are accepting guilty pleas for non-moving violations from moving violations made by CDL holders in both POVs and CMVs. This practice is a clear violation of 384.266. The FMCSA is aware of this. Just like they handled drivers making false DOT Medical Cards by creating the national registry of Medical Examiners and Drivers changing jobs after positive drug tests started the clearinghouse. At some point, the FMCSA is going to enforce 384.266.

    They’re not supposed to make things disappear like they used to. Not sure it’s worth spending a bunch of money when at the end of the day this is how it appears to FMCSA and insurance.
