Got a Citation, Unsafe Lane Change in NC will I get points for it?

    with a CDL the option of having a citation reduced is limited or eliminate totally .

    so
    You have to negotiate quickly on the side of the road .

    If the officer witnessed it , and no other vehicles involved , like Speeding or rolling a stop sign , my tactic is
    “ sorry about this , it would save me a lot of hassle and save both of us several trips to court if you could reduce it a little “

    and if the officer didn’t witness it , the tactic is to show up in court and hope the other person does not appear .
    The first court appearance is usually but not always just so you can plead guilty or not guilty , a total waste of everyone’s time , and if you plead not guilty a second court date will be set .

    in a lot of states you can also request that the case be moved from whatever county or city court , to state court . So the judge and prosecutor work for the state , and the state court is often a few miles away or a lot of miles away and this greatly increases the odds that the officer won’t appear , which usually means your case gets dismissed

    most states allow a jury trial for traffic tickets .
    My state does .
    I don’t know of anyone who has ever spent the time and money for a
    Jury trial for a minor ticket with no injuries .
    If there are injuries claimed and an ambulance chaser attorney involved , then you may have to have a trial .

    I’m not sure when the rule against reducing charges if you have a CDL kicked in .
    In the past I’ve had charges reduced , but apparently those days are over .

    For any traffic ticket that’s a moving violation with points you should never just plead guilty and pay it .

    always hire an attorney and have them fight it

    most of the places like “the ticket clinic “ get their charges reduced or dismissed by threatening a jury trial , and by actually doing it occasionally so the judges and prosecutors know it’s not just an empty threat .
    Even without having a jury trial a good attorney can make a simple Speeding ticket drag on for a couple of hours in court .

    most money hungry cities are used to running dozens of cases through each day , spending less than fine minutes per case .

    once the prosecutor and the judge figure out that this one speeding ticket is gonna take 90 minutes of the lawyer questioning the cop on the stand and asking for their radar certificate and training and calibration records etc etc , the judge and prosecutor will be more than willing to make a deal or dismiss the case .

    Don’t be ‘extra cautious.’ That wears you on your mental state faster.

    The car that was already merging in front of you wasn’t the issue. It’s the next car behind that’ll try to squeeze in front of you. Everyone in cars has this mentality that they will squeeze in front of the big rig, or cut off a big rig BEFORE creating an issue with a car. This is what you did. See a bottleneck beginning on the right, glance in the left mirror and see a big rig, cut left. Happens a million times a day to each one of us.

    Eventually you get to the point to when you see a line of cars on the ramp, nose to tail, on your right and look left and some sort of vehicle is at your trailer, your natural default becomes to just hold your lane and those non merging idiots on the right will just have to figure it out. Sucks to be them. The car merging in front of you is safe. The next idiot will suddenly look in the mirror and jam on the brakes. If they don’t swap paint with you, you keep going. If you swap paint you pull over and call the cops. They get the ticket, because it was their responsibility to merge. If they can figure the merge out, you help by either letting off the throttle or tap the brakes lightly. You aren’t obligated to do this because it’s their responsibility to figure out how to merge. Don’t STOP to let’s some non merging idiot on the highway.

    “Have you had accidents with people who couldn’t figure out how to merge, Six?”

    Three times. Two women and one stupid dude. The women start crying about how they had nowhere to go at the end of the ramp and the dude got angry and asked me if I saw him. I smiled, “Yes, I saw you.” That shocked him. All three times, they got the tickets.

    This kind of stupidity happens every hour of every day behind the wheel of a big rig. If you can switch calmly, you switch. If not, Fup em and let them figure it out. This has to be your default setting, not anything extra.

    Since nobody asked; was a DOT inspection done?

    Did you get an Inspection report from NC DOT?

    Without an Inspection report this won't end up on your PSP record.

    If the investigating officer was not MCSAP [DOT Inspection training] certified AND did not call one in for an inspection then this is just a moving violation on the OP's MVR assuming that NC does report it to FL.

    OP needs to get his state MVR from the DMV and look at it because not every out of state moving violation is reported -or- the state [like NJ] simply lists a 2 NJ DL point violation regardless of the charge for the other state.

    Since OP simply paid the ticket before the court date it may NOT be sent onto his home state.

    Example podunk PA courts usually don't report to NJ [longtime thing between them] UNLESS the individual is a real Jerk with the magistrate; My entire career was based in NJ and I can only remember ONE minor moving violation reported form PA back to NJ...

    OP a real picky...er. 'Safety Centered' company might frown at the lane change moving violation but most companies allow one or two moving violations; especially without any accidents so find out what's on the MVR so you know what any future employer will find.

    I don't use Google. I use DuckDuckGo.com instead. Just search your state + Motor Vehicle Report. My state allows me to see it online. I think the fee is $7 or $10. Your PSP report form the FMCS is $10, but that just records inspection violations on your record, not your tickets.

    To have lots of good options for work you have to never, or almost never, get a ticket or have an accident. They way you don't get tickets and have no accident is pay attention while driving. Now that you have a professional driving license you are expected to drive carefully and professionally even when something makes it more difficult.

    Get 9 more months done without any more bruises you should be fine for the most part.

    How is your current company treating you with that ticket on your record? I’m assuming you already fessed up to them. If not you probably should asap because they will likely be checking your records again as required.

    There were no inspections done, the officer just gave us the report and went about his way, does that mean I might not get any points on my CDL? Would've been nice.

    Mann it's CRAZYYY on how people don't know how to merge, crazy!! I've had some people merge in front of me doing 45 mph on 70 mph interstate!! It's stupidly crazy man lmao!! I honestly thought us big rigs had to slow down or change lanes for them to merge, that's how I was trained at least.
