SCOTUS overturns Chevron deference ruling

With the preface that I am NOT a Legal Eagle..... the CARB idiocy is only tolerated by special permission of the Federal Gov. to Cali. I would suppose that Congress did not specifically direct the EPA to grant Cali that authority.

Lots of ways to pull at threads in just about every kind of agency rule promulgation.

 

While true, they have pushed their agenda well past the borders of their state unfortunately. I wish companies would quit packing freight to them and see how quickly they change their tune when supplies are low.

 

You make a valid point. The Alabama coil certification was overturned because it impeded interstate commerce. Carb certainly does that.
