NEVER EVER!!!! go near company property after drinking. bad news no matter where or who you work for. Bad news you'll lose in any dispute you have. drive a truck ride a bicycle clean toilets you will lose. sorry to hear it happened.

 

Can an owner operator drive his truck without logging if he drops his trailer and goes off duty. I have a friend that hauls out of Indiana but lives in Michigan, he dropped the trailer and headed home which is 250 miles away. Does he have to log the trip home,? he's not working just trying to get home.

Bill, I guess you would have to see how the two interpretations apply to the scenario.


Question 1: A company told all of its drivers that it would no longer pay for driving from the last stop to home and that this time should not be shown on the time cards. Is it a violation of the FMCSRs to operate a CMV from the last stop to home and not show that time on the time cards?

Guidance: The FMCSRs do not address questions of pay. All the time spent operating a CMV for, or at the direction of, a motor carrier must be recorded as driving time.

Question 26: If a driver is permitted to use a CMV for personal reasons, how must the driving time be recorded?

Guidance: When a driver is relieved from work and all responsibility for performing work, time spent traveling from a driver’s home to his/her terminal (normal work reporting location), or from a driver’s terminal to his/her home, may be considered off-duty time. Similarly, time spent traveling short distances from a driver’s en route lodgings (such as en route terminals or motels) to restaurants in the vicinity of such lodgings may be considered off-duty time. The type of conveyance used from the terminal to the driver’s home, from the driver’s home to the terminal, or to restaurants in the vicinity of en route lodgings would not alter the situation unless the vehicle is laden. A driver may not operate a laden CMV as a personal conveyance.
The driver who uses a motor carrier’s CMV for transportation home, and is subsequently called by the employing carrier and is then dispatched from home, would be on-duty from the time the driver leaves home.

A driver placed out of service for exceeding the requirements of the hours of service regulations may not drive a CMV to any location to obtain rest

 

Hey DB what's the protocol if you were to pull over a driver on the interstate and you put him OOS for that? For instance say there is no place with truck parking close by? Just curious.

I always get them to follow me off the interstate before I place them out of service.

 

They probally smelt that you had been drinking when you talked to safety.
Just being on the company property is enough for a randon test of either.

You still dont say what you blew?
U were going to drive your personal vehicle home?
Did you blow more than 0.04?
Did you blow more than 0.08?

 

What is the fine in California for not sliding the tandem ~ I've searched all over the net & haven't been able to find anything?
