Citation for possession of alcohol while operating a CMV...

    I wasn't whining about the CMV possession regulation. I also wasn't trying to start an argument. I was just airing my disagreement with the law. There are many laws inside and outside of this industry that I don't necessarily agree with. I was just giving my viewpoint from a common sense perspective. All are entitled to agree or disagree.

    I can say I have not ever had an open container in a cmv, mor do I think it should be legal. quite the opposite, I think drinking driving and the related offense are delt with to lenient. My opinion is these should be a loss of license, and not returned to a cdl status period, ever. Same with drug offenses. Too many people do not take drugs and alcohol serious, so it needs stiffer penalties'.

    I used to deliver malt and brewing supplies to a guy who made wine. After a few trips he gave me a bottle. Naturally I waited until I got home to uncork it, but regulations aside I see no harm in that at all.

    Please don't spread misinformation. You do NOT have to "pull out onto a public roadway" to have a problem.

    Yes, you CAN be found guilty of DUI on private property. At the very least, in some states. Because driving under the influence is illegal everywhere. So you drink and move your truck from parking to the fuel island to fuel during a break, or even to the tire repair shop on site, or even just to get away from that loud ### reefer, BAM.

    Can You Be Arrested for DUI on Private Property in Florida? -.

    Just remember, ANY accident you are in will get you an immediate "random" test for drugs and alcohol. So you run to the grocery store after having a beer on break and you're PC to Wally world and hit a 4 wheeler, even if you have no open or closed containers in the truck, you will be liable for the accident.

    If you have that much of a drinking problem where you can't go without for a little while while you're in your truck, you need to seek help.
