Logging Off Duty Instead of Sleeper Berth

    Trust me I do not need or want it dumbed down. I run thru inspection alley all the time.
    I am not falsifying logs or making any kind of stand. I am completely in compliance at all times on my logs.

    Show me the reg.

    Totally legal to log off duty while in the sleeper, just not the other way around. The only advantage to logging sleeper is being able to do split sleeper, just has to add up to 10 hours and your good to go, just check your available hours for driving.

    Nope, that's a form a manner violation. If you are sleeping the truck, that is SB time. If you are sleeping outside of the truck, that is off duty time. Logging it as anything else is a violation. PERIOD.

    “So I got inspected at the Cheyenne WY POE yesterday and was cited for false log because I logged "off duty" instead of "sleeper"!!! I wasn't on a load. I was in one place for almost 24 hours. He tells me that when I'm in my sleeper, I have to log sleeper time. If I get out of the truck to eat, shower, or whatever. I have to log myself off duty. Is this a joke? Can someone please shed some light on this as I've never heard of such a thing. This going to be a big hit on my CSA for something so stupid.”

    Logging off duty when in sleeper. Yes or no?

    Show me the reg that allows you to log yourself doing something other than what you are doing. Sleeping in the SB is SB time. Show me the regulation that states you can log SB time as off duty. You have not done that. You just showed a reg stating that you can log EITHER SB or off duty, but not that you can misrepresent what are you doing and log it either way.

    I mean you’re writing chapters arguing what has been shown to you in an actual FMCSA regulation. Just look up the reg in the green book.

    Won't happen, Don't tell them anything, past what is written down you don't have an obligation to talk to them about anything, Never discuss the sleeper entry or off duty status. When I come come (frequently taking my 10 off at the house) I don't discuss it with them, all that is there business is that I took the required 10 hours off, as to where I was during that 10 hour period , That is none of there business.
    When drivers talk to cops trying not to get a ticket, it often times getting them the ticket.

    (E) The equivalent of at least 10 consecutive hours off-duty calculated under paragraphs (g)(1)(ii) and (iii) of this section.

    (ii) Sleeper berth. A driver may accumulate the equivalent of at least 10 consecutive hours off-duty by taking not more than two periods of either sleeper berth time or a combination of off-duty time and sleeper berth time if:

    (A) Neither rest period is shorter than 2 consecutive hours;

    I did. I couldn't find a single place where it said you can log sleeper time as off duty. And since you failed to show anything different and simply misread what it said when it was simply describing how to satisfy a 10 hour break rule, I'll assume I'm right and you're wrong.

    Did you read the thread from 10 years ago where a guy got a violation for doing exactly what you say he can do? I guess not, its much easier to ignore things that prove you wrong.
