Comeback after how long

    You said in your other thread, that when you had the accident, their vehicle had to get towed. The phone use is a problem, but so is the fact that you had accident that involved a tow. Those 2 will make it difficult to impossible to drive anywhere. I think you'll be waiting a while, I'd say even longer than 6 months.

    In your other thread, you say that you were merging. When the car started to pass you on the shoulder, were you completely on the highway, off the on-ramp?

    I had to read his other thread but I think I pieced it together:

    • He was involved in a DOT reportable accident
    • The accident resulted in another vehicle being towed from the scene
    • Dashcam caught him handling his phone in some form or another within 10 seconds prior to the accident
    • He was merging from the right lane to the left lane when the other vehicle swerved around his left side, going at least partially off the road and hitting a guardrail.
    • Werner terminated him for not following company policy, likely for the cellphone use, and they're reporting the accident as preventable to other companies, but supposedly not through DAC
    CONCLUSION: He was involved in accident that he could have prevented. If it's true that the other vehicle was speeding, he should have recognized that before attempting to switch lanes. It sounds like he moved over into the path of a speeding vehicle, which resulted in them having to swerve around him. The fact that he was handling his cellphone just before the accident just reinforces that he wasn't focussed enough before and during his lane change. As for why it's not in DAC but other companies see it, Werner probably reported it to Driver iQ.

    I don't think so. I think clearinghouse is just for drug and alcohol tests that have been failed including not taking the tests.

    You could. But what job are you going to do exactly that is going to help you get experience driving? If you are talking about another job that entails driving a truck subject to FMCSA reg's, it could help. If you are talking about working at Taco Bell, it wont help at all.

    Not that I'm aware of. As far as I know, Clearinghouse just deals with drugscreens, but I might be wrong. DOT would have a record of it, but I think they would only report if he was at fault or not. I think preventable/unpreventable is determined by the trucking company. Technically, his employer could rule the accident as preventable even if DOT said he wasn't at fault. If other companies know he had a preventable, Werner is probably reporting it to DAC or Driver iQ.

    Working at Taco Bell will prevent a gap in employment. Having a recent accident and a gap in employment is worse than just having the recent accident. The job outside of truck driving won't add to his CDL experience, so it doesn't help in that regard as you say. Income is better than no income.
