Broker doesn’t want to pay/one of those days

    They're a scumbag brokerage and they did you a favor. Start your own Do Not Haul list then add this brokerage to it. If you're still in business when the market flips be sure to tell them you don't haul for them when they come begging to get their trash customer's junk moved. Carriers have lists too and tell them so.

    Hi all, the broker sent a response after I inquired about the invoice not paid, more than one month overdue. Their agreement doesn’t specify any TONU rates. Does that mean they won’t pay? Since the driver was released from the load, there is NO BOL. Should I still file on their bond? Or I should seek other ways to collect our payment? They also sent an email not to contact them saying it is harassment when I inquired to be paid. They threatened me to put us on 411 list and Highway.
    I am now leaving this to the third party to resolve this. But not sure yet, if it’s going to be their bond filed on or I will pursue differently. Any insight is appreciated.
    Here is their response:

    “Please make sure you submit the proper POD for the completion of the shipment when invoicing the full amount for the load.
    If you are invoicing for detention, please ensure that in and out times are clearly stated on the BOL/POD by the shipper/receiver.
    For any TONU please submit a signed agreement where such charges are listed and agreed to.
    Any invoices without proper paperwork will be rejected.”

    Here is another response. To them not having BOL is not doing any work. So the driver who was dispatched and sat for hours to be loaded but wasn’t is considered doing it for free if you haul for Jeep Freight.

    “At this point this is turning into harassment.

    You do not even have the proper paperwork to bill for this shipment.

    You never did the shipment. Your driver left; you are not entitled to anything. You will never be paid for something you did not do.


    If you continue to harass my team, I will be forced to report your behavior to agencies such as carrier411 and Highway.


    This will be the last time we respond to you.”

    Wow. You are the perfect example of why the industry is in the condition it's in. You don't even know how important the BOL is. You're beat. The broker doesn't have to pay to a dime when you can't even prove to delivered their customer's freight.

    You didn't mention any of this in your first post. The problem is you, the carrier not the broker. Why should they pay you for anything? You're out there running a charity instead of a business letting brokers tell you what they're going to pay or not pay.

    You're just bleeding a slow death.

    Its true,
    The BOL is your POD (Proof of Delivery).

    Without that you
    haven't a leg to stand on. :cool:

    We have records, not BOL. I have the message the driver was finally released.

    A driver cannot be expected to wait indefinitely to be loaded, especially when the receiver would close.

    Doesn't matter. You'll spend way more in legal fees and lost time fighting it in court. No insurance company will pay the bond claim without a signed BOL.

    Maybe, we get that kind of treatment because people like you allow it. And it destroys the rest of us.
