I don’t think you’re picking up what I’m saying. The state can do whatever they want. It’s a jury that will decide guilt or innocence and it’s a judge that will decide a punishment. The phones laptop and speed is what will convict him. The hos violation of 23 minutes is insignificant. It wasn’t 23 hours. It will not add time and it’s the least egregious of all the charges.

A year of probation for reckless homicide in Indiana? Keep dreaming.
Indiana is heavy handed on such charges.
Reckless homicide is a Class 5 felony in the Hoosier State.
If convicted that driver is looking at 1-6 years in prison and a fine up to $10,000.
Plus a license suspension of 2-5 years ,in which the court may recommend the length of the license suspension (it could be shorter,it could be longer).
Regardless if the HOS violation is 23 minutes or 23 hours-it’s still a violation in which a lawyer can capitalize on that(“if the driver hadn’t exceeded his on duty/driving hours he wouldn’t have been involved in the accident”)or some other BS. And that state has plenty of lawyer billboards for truck accidents. Any of those lawyers advertising would be more than happy to take a case like that,as that can be used in a civil suit against the company and the driver.
And that’s just 2 charges to contend with.hope not dumb twucker Thanks this. -

More than likely he will be convicted of 2nd degree homicide by vehicle which is a misdemeanor. Maybe hit with criminal negligence which is a class f and carries a 6 month to 2.5 year sentence

I lived in Indiana (2005-2007) and in that state sometimes plea deals aren’t going to be on the table.
Also in Indiana once you are sentenced,in accordance with their statutes they send you off to start serving time immediately,no time to settle up affairs. -
