FMCSA hypocrisy

I'm not going to get too deep into the politics of the thread subject. I'm just going to repeat something I learned decades ago. Two wrongs don't make a right. As I read through this thread, my mind went back over all of the FATAL accidents I know about, and I am privy to the facts about them. I am not talking about a few. I am talking about 23 of them since the mid 1990s. All involved a Class 8 truck, and ALL were the fault, at least partially, of the driver. In each case, the driver was a US Citizen who spoke English.

There is not an ounce of data that supports non-English drivers being involved in a greater number of at-fault accidents than US Citizens. I will keep my opinion of multiculturalism to myself. That case out of NY was right on. BTW it was NOT the FMCSA that prosecuted him. It was the US Attorney's Office that chose to charge him, the FMCSA supplied most of the evidence used to put him away.

Here is where I caution to stop looking at statical analysis without the underlying data not being available.

STATS are not always accurate. People who do statistical analysis are noted for using stats to further agendas. Always take stats with a grain of salt!

 

Well said, and just to backup part of what you said from the fmcsa. They got into this issue a few years back.

“FMCSA has concluded that at this time there is no quantifiable data on which to propose modifying the regulation to require a more stringent or definitive standard, or to require State motor vehicle agencies to administer a specific test for English proficiency.”

Nobody has stated that Werner should not have been moving, but his voilation simply put him in the wrong place at the wrong time. As every driver I know has been a sometime in there driving careers.

 

It is a requirement. So it should be enforced. It is also a safety issue if they can not read signs.

 

Sounds like you didn’t read the relevant facts of the appeal.
They commented on how many accidents he drove by and how many opportunities he had to get off the interstate etc etc etc. Testimony shows that he had been driving in it for quite awhile.

The blame wasn’t all put on the driver, the largest % was put on Werner since they are the carrier and responsible for safety. Their complete failure to instruct drivers properly is why they got hammered.

If it was me getting sued my insurance company would just settle out of court, cut them a check and be done with it. If they wanted to come after me for more, well good luck with that.

I’m almost positive that Werner was offered a deal and thought they would prevail in court..stupid move imo.

Case is already under review with the TX SC should not be long now before for a closure.

If I were to put money on the outcome I’d say the original judgement will be upheld and the financial award lowered just a little bit.

I missed one giant fact..

No one had to say it because TX law requires you to stop driving.
