Passengers in Tractor-Trailer

    What is the law (if any) about carrying passengers in a sleeper cab tractor OTR? Specifically on a 3rd passenger... Is it allowed?

    Is it different if you have 2 drivers team-driving and a 3rd passenger in the passenger seat?

    What about one driver and two non-driving passnegers?

    If anybody could answer this and point me to an actual federal regulation about it, I would greatly appreciate it.

    Last week I saw 5 people climb out of a Prime truck,

    Jose, Maria, and there three little ones.............

    Must be fun !!!!!............ NOT !!!!!!!!!!!!

    Hello and Welcome:)IMHO all passengers would need their own seat and seat belt. Driver training trucks are modified to accomodate multiple passengers. Best to You!

    Sure it's legal.

    For school we have more then 2 people in a truck all the time. It's uncomfortable having 2 people sitting on the bunk. That's why I like the truck with the double bunk.

    §392.60 Unauthorized persons not to be transported.
    (a) Unless specifically authorized in writing to do so by the motor carrier under whose authority the commercial motor vehicle is being operated, no driver shall transport any person or permit any person to be transported on any commercial motor vehicle other than a bus. When such authorization is issued, it shall state the name of the person to be transported, the points where the transportation is to begin and end, and the date upon which such authority expires. No written authorization, however, shall be necessary for the transportation of:
    (a)(1) Employees or other persons assigned to a commercial motor vehicle by a motor carrier;
    (a)(2) Any person transported when aid is being rendered in case of an accident or other emergency;
    (a)(3) An attendant delegated to care for livestock.
    (b) This section shall not apply to the operation of commercial motor vehicles controlled and operated by any farmer and used in the transportation of agricultural commodities or products thereof from his/her farm or in the transportation of supplies to his/her farm.

    my carrier requires that any passenger has a completed pasenger authorization form on file at HQ.

    I've got news for you...That aint legal unless the two people sitting on the bunk have seat belts...
    The cheesey schools do it all the time but it's NOT legal!

    So basically, 3 people would be the max then. One driver, One seatbelted Passenger, and One "belted in" in the sleeper cab. That's what I gather from this then.

    They would all be employees so they would be exempt from 392.60a, but I just wanted to make sure 3 or more people was not illegal per any other regulation.

    that is correct , very good post and precise. not widely enforced for some unknown reasaon how ever the state of arizona does along with a few others, the fine is or was 150.00 bucks per passenger. is she worth it ?
