Try 392.3. It is a matter of opinion as to whether you are tired or fatigued.

I request inspections a couple of times a year particularly when I'm in California so I can get the stickers on my truck and trailer and be done with it for a while...The inspectors are generally pretty cool about it when you ask for an inspection and have a decent attitude with them.

Also...A few good inspections will help up your score if you are a small carrier and that is a good thing in the long run.

Having the sticker is no guarantee that you will be left alone.

I got level 1 in Missouri on a Tuesday morning. Indiana in the same week on Friday afternoon, another level 1.

Just keep 6-10 inches of junk and stuff on your dash...you will get plenty of inspections.

In other words...keep your dash clean! I see (mostly at Truckee, Cottonwood, and Dunsmuir that a nasty dash will get pulled into the shed 7 out of 10 times, while the rest of us keep rolling along!

It seems to me, not from experience as a driver, but from experience in the construction industry, that some inspectors like to "show their stuff"...and I mean that in a good way. More than a few times when I met a building inspector on a job site, I would pick their brains about what I could do to prepare better for an inspection even though I had a number of years experience. The better inspectors liked to bring me up to snuff. My boss was a stickler for detail and would let me know, in no uncertain terms, that failing an inspection didn't just cost him money. It also cost him reputation points.

I am aware of 392.3 (Ill or fatigued operator) No place in that reg. is any mention of a matter of opinion as to anyone being able to take enforcement action. Basically that reg. states you shall not drive ill/fatigued nor shall a motor carrier force you. OOIDA has beat a fatigued "opinion test"

Who determines that you are not fit to drive during the inspection?

Tell that to the boys in blue (or whatever color their uniforms are) in MN, or was it MI that were nailing "appeared to be fatigued" drivers!
