I actually agree with what you posted there Opus.

And what you have pointed out about situational awareness and thinking ahead are major failure points across most population segments.

Unfortunately the accident investigators will need to assign blame, so that the lawyers, accountants, and judges can decide damages.

My opinion: the WE driver messed up and did not safely exit and return to the highway. U-turn verses left turn across a double yellow line is kinda a pointless argument for us, but one the investigators will probably bicker about for a week or so.

My opinion is also that the pickup driver probably shares some of the blame. The stereo type of Cali population being in the midst of Cranium Rectal Insertion Bliss most of the time is not an unfounded generalization. This should be an assumed medical/Psychological condition until proven otherwise.

Also some of the blame may fall to the nanny state for not being an effective enough nanny... even though not enough bubble pack nor duct tape has ever been created to deal with the crap that most of the population seems to get themselves into.
