I was issued a one year disqualification in June 2025 after I got the CLP permit for an OVI, which later was plead down to a physical control. I requested an appeal with the BMV and was told my case was "stayed" until the outcome of the hearing, which they do not have an estimated date yet. Does this mean that the suspension is no longer in effect and I can go to school to get the CDL license? I already talked to 3 companies and a local CDL school and explained my situation, and they said I'm good because technically the charge I was convicted of is not an OVI.

What is OVI and BMV?
Did you have alcohol or drugs in you while operating a vehicle? You must be leaving key words out of the description because every drive in a car is in physical control. Please don't skip important words and then expect an informed answer. We are not cops and prosecutors who use this shorthand language all day, every day. We can read what you write, so it's important to understand you have time and space to write a full description. However, even a full description from only one point of view, yours, isn't hearing both sides of the situation.
I don't see how a license that was suspended or disqualified in June 2025 is valid before June 2026. In a job market where there are too many drivers, employers aren't rushing to hire drivers with alcohol/drug offenses on their record. Also EVERY CDL school is in the business of collecting money from as many students as possible. They have little or no reason to tell you not to give them money even if they know you won't get hired, if that's the case. If you ask a barber should you get a haircut, what is the answer every time?snowlauncher, drvrtech77, Concorde and 1 other person Thank this. -
You might get more help in the Trucking Regulation section or the Experienced drivers advice section than in the Welcome Wagon section.

Regardless of pleading the OUI down It’s still an alcohol offense.

He got an OUI while having a CLP.. plead it down to a lesser offense..still alcohol related though. Now he’s trying to get the DMV to remove the suspension..

Personally, I’d give up on trucking for a few years. Your suspension for a year due to alcohol isn’t going to get you hired by anyone the least bit reputable. Carriers will see it on your mvr when they pull it.

You literally wrote an entire paragraph making accusations. You don't need to know what my court case details are buddy. The conviction was dropped and that's all anybody needs to know. That is why I don't need to fill you in with the details, but if you insist, here you go! Grab your readers because it's story time.
In the beginning of Summer this year I was actually celebrating getting my CLP (Commercial Learners Permit) after wasting a decade of my life doing odd jobs and trades where I had nothing other than depreciating assets and debt to show for. I was out doing what I do best, causing trouble at bars and night clubs and fulfilling my duties as a male to approach women which is a dependency in order to sleep with them. After getting kicked out for behavior that is expected for men to do, but at the same time unacceptable when we do it, I was forced to leave the bar. Funny how that works. You go to a designated place to do two things. Drink alcohol and talk to girls. But we are in an age where everything is a social construct, including social norms that are selectively enforced based on a male's social standing in that particular circle. So it shouldn't be that unreasonable for a casual observer to believe that I did nothing wrong and was just doing my duty as a man. I think it's funny when I do what is expected of me, like driving the speed limit, and watching all the negative reactions others have. That is why I believe I actually have the ideal personality of a truck driver. If you have a problem with me, then that is actually your problem. My stoic mindset is ironically why I am a supreme alpha male and would be a perfect professional driver.
Now, back to why I have a one year CDL (Commercial Driver License) suspension. When you are told to leave the premises of an establishment for simply violating unwritten rules that are subjective to one's personal beliefs in a soy-society of SIMPS (suckers idolizing mediocre
), you don't have many options that actually make sense. If you don't know your exact intoxication like 99% of people that drink at bars, you risk driving intoxicated if you leave. If you drove by yourself and don't have a DD (designated driver) that is sober, you can't have someone else drive for you. If you don't have any friends because you are an introverted man that doesn't like to socialize, then you probably won't have anyone to count on to help you either. If you believe you may be intoxicated, you can't wait in the parking lot of any business that told you to leave, and doing so may get your vehicle towed or worse, some loser that you pissed off in the bar might assauly or even kill you because life for men in modern society is essentially the same level of anarchy that men of prehistoric times have lived through, but enough of that. There basically is no option that is safe, affordable, or legal in this case. So I took my chances and got out of there.
The story doesn't end there. When I got home the cops showed up to my door step because I left my debit card at the bar because for some reason the employees at that bar don't understand what a "debit card pre-authorization is", and feel the need to actually physically hold onto your card unlike 90% of bars where they return your card. The police told me they had me on video leaving the bar and asked me to do a field sobriety test, which I thought was BULL (I think you know what that stands for) which I did not agree to do because, well, not driving. Because of my refusal to do a test meant for drivers, at my home where I was just resting in my bed minutes earlier, I was arrested and taken to the station where I was forced to make another decision. Take or refuse a breathalyzer test. I ended up proceeding which the result was slightly over the legal limit. This failed breathlyzer test is the reason I am disqualified for operating a commercial motor vehicle, because I held a CLP permit at the time of the incident.
I hope that answers your question.Last edited: Dec 3, 2025 at 4:02 PM
Bean Jr. Thanks this. -
I already spoke to three companies that told me I would get hired with the Physical Control charge once I have the license. Instead of giving up like you say, I will find a way to my destination. That is literally what this job is aboutLast edited: Dec 4, 2025 at 2:49 AM

I read the first paragraph and figured "this guy is a one and done!", but I read further! Man, I hope you're not a one and done, you belong here. That was pretty funny. And also a first class railroad one you. I hope you get the suspension removed, and don't ever do that again!dosel Thanks this.
