    I'm actually curious about this too. I have 2 convictions, (possession of a weapon, and common assault) will these matter much to a company? I have a perfect driving record and am working on my 2nd year heavy duty tech.

    In an earlier post, someone gave some info on time (since the conviction)...both of those could spell some trouble, and don't believe a recruiter for a CDL school, all they want is your money, they could care less if you can get employment after the fact.

    Oh god. So the police, prosecutors, judge, jury are all right, right? Every time, right?

    I was falsely accused of assault and battery once by someone who is supposedly my dad.. Have you ever been in the legal system as a "criminal"? If you don't have a lawyer, prosecutors are extremely high-pressure salesmen. They don't want you to go to court. They want you to plead guilty. They pressure innocent people into doing it for fear that they'll lose the case. It's a sad thing.

    And to get a court appointed attorney in michigan, I had to talk to the prosecutor first. To be perfectly honest, I pretty much didn't tell him a #### thing except that i'm not taking his ###### plea bargain and I need a court appointed lawyer. I was very quiet and polite and professional and tried to not give him a bad impression of me too. Very scary situation.

    They try to sell you on plea bargains with "oh you wont go to jail and you wont have a criminal record". ########. There's a record that I was in that room talking to him, everything is on record somewhere.

    My mom even tried to get me to take the plea bargain. Hell no. I stood up for my RIGHTS. and i won.

    If "dad" would have showed up to court I would have lost. He's the biggest lying scumbag I've ever met. He could convince you the moon is made of cheese.

    Would you seriously hire someone like that over someone who doesnt beat people up and has experience?

    I was falsely accused of two felony charges by this scrub strap-on D.A. here in Dago... long story, I'll try to condense it: punks repeatedly vandalize our house on the fly in the middle of the night, cops go with "deliberate nonperformance" because the cops and I have had issues in the past over truck parking in front of my house, two false reports and two false charges are filed, punks turn out to be the same scrubs who do the towing for the crooked cops (same cops who shot NFL ballplayer Steve Foley and got away with it, at a cost to taxpayers of $5.5 million), cops back punks with falsified reports, case goes to jury trial AFTER I drop-kick my worthless "Public Defender" (best move I ever made, and I'll tell you why in a minute), cops and punks are all proven to be absolute liars as none of their falsified reports or false testimony given under oath match the "9-1-1 Call Center Log" (classic Perry Mason move by yours truly), I am acquitted after an 8-month courthouse ordeal, none of the punks or crooked cops are ever held accountable for their falsified reports and perjury under oath, despite the heller waste of public funds (i.e. tax dollars) associated with the false reports and the false charges.

    Having said all that, I hope you're still with me, because you can learn from my ordeal... that whole business about "never representing yourself" is absolute hogwash, a myth perpetuated by scumbag attorneys and pocket judges in the judicial system. In my case, my so-called "Public Defender" did NOTHING to help me; in fact, she went out of her way to be unhelpful, and she was clearly in league with this crooked scrub D.A. (that scumbag has a LONG HISTORY of malicious prosecution on the taxpayer's dime---check out the Cynthia Sommer case on the Internet, that's just one case out of many). Biting the bullet, I decided to represent myself... BEST MOVE I EVER MADE IN THIS WHOLE ORDEAL. You see, once you go "Pro per" (as it is called when you choose to defend yourself), the D.A. and her lackeys are forced to turn over all of the so-called "evidence" which they plan to use against you. Sifting through that pile, I discovered the proverbial "Silver Bullet"---in the form of that 9-1-1 Call Center Log (records time of all 9-1-1 calls, as well as call content). Had I not found that single paper in the huge stack of b.s., things might have gone worse for me---I was looking at 3 years, 8 months, on two trumped-up charges. Of course, the contradictory statements made in falsified police reports and false testimony given under oath didn't help the prosecution, and I was quick to point out those discrepancies to the jury.

    My strategy was simple when I entered the actual trial phase... ignore the crooked pocket judge (lot of those scumbags around these parts) and focus all my energy upon the jury of my peers. When defending yourself, you have two stellar opportunities to address the jury: you make an opening statement (this is the critical one) and a closing statement or argument. I carefully composed my opening statement, listing relevant points in order, and held a condensed version of this in my hand as I addressed the jury. Wearing decent clothes didn't hurt... not a suit, but nice dress shirt and tie, slacks, and highly-polished shoes. When it was "showtime," I stepped forward and handled my business like a pro... the jury listened intently as I presented my side of the case, and my peers were smart enough to see through all the b.s., thus I was acquitted. For months following the trial, I sent detailed accounts of the whole crooked public-fund-wastin' fiasco via certified mail to a hundred different government and media agencies, as I was pissed off by the blatant malicious prosecution and clear violation of my civil and constitutional rights. My uncle was a judge down in Dallas, TX, and there are attorneys in my immediate and extended family, so that helped, not only during the "trial" in kangaroo court, but also in the aftermath. Long story short: NOBODY CARED. I even bombarded that Holder idiot and ol' Obama himself on that White House website, day after day after day, using the foulest language toward the end and probably actually breaking some laws in the process, as I was heller angry, especially since the punks and their crooked little a$shole buddy cops got away Scot-free with their criminal bull$h!t. Again, NOBODY CARED. Too many other greater issues on their plates, I suppose, with the economy tanking and everything else going on...

    I've let it all go, and now I'm simply looking forward to going back out on the road where I belong. My OTR driving career was put on hold throughout this ordeal, as the false charges were felony charges, and one is not supposed to cross the state line with felony charges pending, or so I was told by a court clerk (before anybody comes back with a rejoinder on that one). I was actually laid off from my last decent company the very day I came home to find the "Notification of Arraignment" in the mail... not a very good day, in retrospect, but it's now ancient history. I didn't bother looking for OTR work while contesting the charges, as I knew I would NEVER make it back for every hearing (a dozen ridiculous public-fund-wastin' hearings capped by a three-day jury trial). I borrowed $7000 from my best friend during this ordeal, and spent hundreds on postage, copies, etc., etc. That same friend has ridden with me OTR and has seen me make $2000 or more in one trip, so he was okay with it... not a fair-weather friend, my hand Tommy. Others who "didn't want to hear about it" were promptly drop-kicked out of my life, as if I was starrin' in the NFL... I'm hard as nails that way, and I figure "good riddance." Sometimes you just have to shake the tree to get rid of the bad apples...

    I kept all the "evidence" and court-related documents, of course, not only to protect myself but to present as actual evidence of blatant malicious prosecution if anyone ever follows up on all those letters and e-mails I sent with regard to this criminal fiasco. I even kept the blank DVDs the slimy strap-on perv D.A. tried to slip into my "evidence" collection, that crooked scumbag. I recently read that the worst offender and perjurer joined the Army... if the punk even makes it through Basic and AIT, with any luck he'll get whacked overseas---never thought I'd say that about a serviceman, but, then again, he isn't a serviceman yet, just a punk who joined the Army. His greaseball family lost a big share of the towing contract with the City of Coronado, and those dirtbags aren't looking so prosperous lately, so with luck they'll soon be out of business. Naturally, I've asked my friends to spread the word about those lyin' greaseballs... what kind of idiot takes his car to get serviced by documented liars? I even wrote the local rag with a detailed account of that whole fiasco, and included copies of court transcripts wherein the scumbags changed their stories half a dozen times under oath. Of course, the greatest damage will come from my bro Tommy, whose family ran the local surf shop for 35 years---those boys know ALL the old school locals, and, evidently, these unlocal punks have bothered others here in town, so their bad karma is catching up to 'em pretty fast. That's the good news...

    One thing I learned from this whole ordeal: if you are ever falsely charged, IMMEDIATELY GO ON RECORD AS CHOOSING TO DEFEND YOURSELF ("PRO PER"), AND GO ON RECORD AS REQUESTING A JURY TRIAL---IT IS YOUR CONSTITUTIONAL RIGHT. What many people don't know is this: you can always go back to having an attorney AFTER YOU PERSONALLY CHECK ALL OF THE SO-CALLED EVIDENCE. I can't stress this all-important point enough... nobody else knows the details of your "case" as well as you do, and no scumbag attorney is going to bother closely poring over every last document in your case, so it's up to you. The scumbag "Public Defender" in my case wasn't smart enough to catch the discrepancies in the so-called "evidence"---it was a bold step, drop-kicking that useless rat t#rd and striking out on my own, but it was the best move I made in that whole fiasco. One particular judge (there were half a dozen throughout the hearings---some kind of crooked shuffle set up by the D.A., I reckon) was more honest than the others, and told me I had the right to go back to being represented by an attorney if I ever felt I was "out of my depth." If I am ever falsely charged again, I will immediately go "Pro per" and request a jury trial---that way I'll have the opportunity to closely scan every document and figure out how the lying scumbags put together their trumped-up charges. Liars with badges... just another sad reality here in Dago, and elsewhere too, I suppose. I never wanted anything to do with those scumbags, but at least I have the satisfaction of knowing that I backhand-b*tchslapped those scrubs in their own rigged courtrooms, and did it with style... even though it cost me heller time and money.

    Well, that's my saga... or one of 'em, anyway. I only throw it down here because I see that convictions are an issue with some hands. Phroziac is right: the scumbag attorneys don't care about your personal welfare, they just want a "plea bargain" to quickly resolve the case, and that is no bargain for the hand being falsely charged. My code of ethics is pretty simple: treat others as you want to be treated, and, if it doesn't belong to you, don't touch it. Obviously, this post does not concern "driving awards" where the hand has been caught (on radar or laser) fair and square by some revenue collector hiding in the bushes... contesting those tickets is probably a waste of time, although you may still be able to keep it off your MVR by attending "traffic school." Okay, I'm outta here... every time I relate this story in the future, if I even bother doing so, here's what I'll look like... > :biggrin_2559:

    Very interesting story and thoughts there rail; i will read it when i have more time and awakeness (since i work nights now).


    But back to the question:
    1) First off, since you're 20, most OTR companies would not hire you anyways even if you had both records spotless. They don't start hiring until 23 and some not until 25,6. i think this is mainly for insurance reasons.

    2) how old are the tickets?

    Yeah... "interesting" to those who didn't have to live it, I reckon. The courtroom saga was just the tail end of the story... the vandalism went on for several years. Bear in mind that I would often be out on the road when this vandalism occurred... come back to it, call those worthless crooked scrub cops, and never see any resolution due to their "deliberate nonperformance." If you think that situation isn't frustrating, try it on for size... there were also several incidents involving carloads or SUVloads of punks lying in wait outside my house at night, with ugly confrontations and actual scraps as a result. Got their plate numbers as well and sent them nationwide---nothing was ever done about it. Naturally, I was listed as the "aggressor" in every incident, even though the punks were clearly stalking and harassing me and my family. It didn't die down until they got slapped around a bit and had restraining orders slammed on their trouble-makin' punk ###es... something I forgot to mention in my original post. Bear in mind that we never wanted anything to do with any of 'em, but, on the other hand, we will vigorously defend ourselves and our property, and we have successfully done so in the past. People often ask me why I just didn't put up cameras, or those "flash boxes" (can't remember what they're called... game cameras or whatever) from Cabela's that take pictures of anything that trips the sensor... I looked into all that, but the bottom line is that these punks came in the middle of the night, wearing hoodies and all that bull$h!t, so no camera would have worked well enough to produce photos viable as evidence (no cameras I could afford, I mean). I did install powerful lights which really cut down the criminal activity---####roaches don't like light, 10? Anyway, the ordeal is basically over, and the punks know not to bother us anymore... we still get the odd punk throwin' down trash and yellin' in the middle of the night, incidents which aren't worth reporting to these crooked scrub cops. The way I see it, these punks will soon be driven out of town when their business fails, and good riddance... in the meantime, whenever the topic arises, I'll be sure to put in my oar, so to speak. Punks and wannabe gang members are all the same: cowardly trash who don't have what it takes to step up and scrap on a one-to-one basis. That's my $.02 on that whole situation. I only posted this ridiculous saga because I figured others might learn from it... if the info contained in these posts helps even one hand going through similar grief, then this info will have been worth keying on this computer. Thx 4 the reply. "Adios!"

    Oh, I almost forgot to mention... I was supposed to leave for Orientation today, but my elderly mom (84) went to the ER the other night with a bad injury. Thought it was "water on the knee" at first (I've had that before and I know something about it), but it turned out that blood was collecting in the joint... she spent last night in the hospital, and she'll probably be there again tonight. In fact, the doctors may have to perform surgery, in which case she'll be there for several days, if not longer... with all that in mind, I've decided to postpone my return to trucking for at least a week, because she has been in excruciating pain and she will probably be unable to get about when this situation is finally resolved. The company is cool with it... which I appreciate. I don't like the fact that blood is involved, due to the risk of infection... something which can bring on a crisis in short order. Anyway, I'll be doing my best to see that she's okay, as she is a living saint (I'm not, but she is), and I love her with all my heart. Alright, now I'm outta here...
