That's what they always say. Which is why, in many places, cops call it "Deuce"
His blood-alcohol level was .127
And this puts the lie to it. Two beers will not give a grown man a BAC of .127. Unless said grown man weighs 70 pounds.phroziac and RAILSPLITTER Thank this. -

Couple of beers is almost always at least a six pack. -
I'd like to know how he can be charged with 2 counts of DUI, when he was only caught doing it once. That would be like getting 2 counts of murder for stabbing your victim twice in the chest. You only killed him once, so you only get one charge. Now if they want to charge him with 2 counts of reckless driving (one for each reported car forced off the road) in addition to 1 count of DUI, that would be OK, as each incident was a separate occurrence....but I fail to see how the second count of DUI will stand...double jeopardy and all. -

OBTW the term "deuce" came from the OLD California Motor Vehicle Code when DUI was a violation of section 522. They called it a "deuce" just as cop speak. The current section, (unless they have changed it,) is 231152, so you still have a couple of "deuces" in a "deuce."

Because if he was pulled over, field tested and failed, then insisted on getting back in the truck and trying to drive it, that would be two separate counts. Yes, I have actually seen drunk morons do that. They get the idea in their heads that they are free to go (or can get away) even though the officer has told them specifically not to....try to drive and then get charged with a second count.
