In California, my buddy who has a CDL got pulled over for speeding in his motor home coming from the river and blew a .09. cop told him he was over the .08. Well long story short, he got booked for DUI over .08, not ".04" cause he was not in a commercial vehicle. He hired a lawyer for $8,000.00 up front and had it the DUI reduced to a minor speeding ticket. :biggrin_2556:

I thought it was any detectable amount, but apparently I was in correct CA DMV states its .004 BAC. Heres the link. www.dmv.ca.gov/pubs/hdbk/actions_drink.htm

But I still believe that it is a state by state basis.

It's any detectable amount if your are operating your CMV. That's from FMCSR, not from the states. If you are in interstate driver, you will fall under these federal guidelines.

Read it again, It say .04 "ANY VEHICLE REQUIRING A COMMERCIAL LICENSE" in other words you have to be in a "COMMERCIAL VEHICLE" in order for .04 to be in effect.

this fella did not ask for your opinion on whether he should drink or drive or his personal habits...he asked if he was held to cdl laws while not in a truck.....the answer is yes....let the girlfriend drive and drink away brother.....happy trails
