In California, my buddy who has a CDL got pulled over for speeding in his motor home coming from the river and blew a .09. cop told him he was over the .08. Well long story short, he got booked for DUI over .08, not ".04" cause he was not in a commercial vehicle. He hired a lawyer for $8,000.00 up front and had it the DUI reduced to a minor speeding ticket.

I thought it was any detectable amount, but apparently I was in correct CA DMV states its .004 BAC. Heres the link. www.dmv.ca.gov/pubs/hdbk/actions_drink.htm
But I still believe that it is a state by state basis. -
It's any detectable amount if your are operating your CMV. That's from FMCSR, not from the states. If you are in interstate driver, you will fall under these federal guidelines.
