Sometimes we have what is called selective vision, If a driver was told to look out for a business on his left to enter the drive way and upon turning would stop and look in both mirrors and procede if the road was clear. No Problem Right.

But, here is the problem. Without notice a dark skin pedestrian dressed in dark clothing decides to stop while walking and crossing the driveway. Since it is dark and the person is stationary the perfial vision does not respond. The road is unlit and the driveway is black pavement. The tractor trailer runs over the pedestrian and injures him. The driver swears" he looked both ways and did not see the Person enter his path as he turned. Since the Driver was looking for a business and not a pedestrian his mind was focused on the traffic on the street and not the pedestrian.

Who is at fault the driver or the pedestrian?

Was she BEHIND the solid white line at the intersection? or sitting about a car length past it like most cars do???? After being hit, why did she not call the police and follow the truck????? You say both lanes where traveling in the same direction, but if one was a left turn lane and the other was continuing straight ahead...Then, They were NOT both going in the same direction? right??? A 22 year old girl could probably come up with a wild story by the time she got home about what she "thought" happened. Not placing blame on anyone here. Everybody makes mistakes and if the trucker truly did hit her, then he should have stopped. I just find this story hard to believe that is all. If it was a busy intersection, may be a traffic camera nearby. I searched WILKES-BARRE, PA for a Highland Blvd. and cannot find one. There is a Highland Park Blvd. and a Highland Dr. but No Highland Blvd. Hmmm!

She was coming from work at the mall.... I know from personal experience that place around malls aren't designed for trucks. SO was this guy swinging wide and she thought she could get thru or what? I know I've had this happen to me before and have sent numerous idiots over the median curbs.

Or is a possibility of daughter sitting at a green light and truck now has to go around her to avoid a rear end collision where he swings right into inner lane and then proceeds around her? I have seen similar situations when people are sitting at a green light "texting or talking on cell phone".

I thought maybe someone on here might be able to help me figure out what company he works for, but it looks like a lot of you stick together and blame the person who isn't a trucker. Maybe I shouldn't even be part of the trucking industry if this is what people who drive truck turn into.[/QUOTE]

All you say is a white truck, and give 3 letters or numbers of a license plate number. Do you know how many different companies have white trucks????????? You dont give much to go on dude!

If thats your attitude friend then you dont know much about the truckiing industry I have personally been involved helping police nab drunken drivers on more than one occasion.. Your story changes from post to post and any time some one asks somthing you go on the defensive.. I drive a white truck?? do you think I may have done it?? BTW im also 3000 miles away but because im a trucker im a lier I guess huh?? Maybe send the daughter to a defensive driving course or even a Smith coyrse.. and quit tryin to piss of folks who were trying to help...
