you have to ask them "what probable cause do you have to search me?" if you flat out say "no" then that is most certainly probable cause because you're denying them, there must be a reason, if it was as simple as a "no" everyone would say no. you have to make a cop spell everything out in clear english and if they start getting fishy tell them you want a lawyer present before you step out of the truck or answer anymore questions. if they say something like " oh level with me get out of the truck " simply say "detaining me or am i free to go" i think it even says that in the video posted but i didnt watch it, but that is a key phrase to say because if they say "yes i am" then you ask "what are you detaining me for" and if they cannot give a valid reason you'll end up running in circles and they will let you go, i have done it before and it pisses them off so bad because they know they arent dealing with a typical citizen that bends over and grabs their ankles cuz a big scary man with a badge is telling you what to do.flightwatch Thanks this.

i've not been searched SEVERAL times after being asked "if i minded a quick search" no sooner than they asked i said SURE. LOL end of story, have a nice day

NOT TRUE!
OLD DRIVERS HOAX TOLD ON CB AND AROUND THE DINNER COUNTER!
Heres why it's a rumor!
1- The job of the The US Marshalls Service is to protect the Federal Courts and the people who work for it.
2- The perview of the USMS is to protect the courts, assist other police agencies when needed, collect monies and impounded vehicles, buildings and other properity when ordered by the courts or seized in raids. They also have their own most wanted list.
The ONLY place you will find a US Marshalls office is in a federal court building or very close to it.
A CDL does NOT mean that you are under some kind of Federal protection!
There are idiot truckers that heard this story and to make a good story better they keep it alive but ask them how to get in touch with a US Marshal's office, they have no clue!
Lets make it simple! If you are say in BFE and a cop thinks you need to be searched or that you have contraband in the trailer, he's going to open it! YES, if you have some government load he can open the trailer! The USMS could care less what is in that tractor or trailer! You want help call his supervisor or the next highest police department avaliable!
I can guarantee you that when you do figure out how to get in touch with the closest USMS office to you the first thing you'll hear after you "demand satisfaction" will be either crickets in the back ground, a Marshall or a secretary laughing their arse off at you or a click as they hang the phone up! SO if you are in BFE do you really think a US Marshall is going to come to your rescue?

OH I found this out on Jan 20, 1994 the day before my son was born while in OKC and having a problem with a receiver. I had heard the stories from other drivers and so I called! After the officer on the phone finished laughing he asked me if I had heard that story from another driver? He then gave me the number to the Public Affairs office in DC and I had a nice little chat with the PR lady for the Service back then!
What I out lined above is just a part of what the Service does!
The movie Convict Air could be true as they do have a small fleet of Aircraft and a fleet of buses both used to transport federal prisoners across the country and they also lease these services out to O/O's too!
Cliff Hanger could be true as that's about the only way these things would be transported!
They also have a fleet of trucks for these loads you hear of that not a single driver in America will ever haul such as some stuff used in military applications and a few other things that you've heard that this driver had escorts and armed guards and that a DOT cop went to open the trailer and the next thing there were US Marshalls all over his arse! These make great stories but they belong in the movies or a Tom Clancey novel!
Now their fleet DOES have escorts if the load so calls for them. You'll see a truck with an MK-16, HK or a shotgun in a holder on the dash and 2 drivers in the front but you won't see the 3rd guy in the sleeper. You'll see the escorts in front and back and the floater. All with weapons mounted to the dashboards! Before EZPass they passed the scales with no problems!
If you want to try to call and get some help then call the city where the nearest Federal Court is located and try to get someone to drive a few hundred miles to assist a silly truck driver with a DOT or police problem!
All the freaking CDL is, is a standard across the board drivers license made this way because back before what was it 1981or 2, I don't even remember, there were so many different rules that applied to trucking and most of us with a chauffeurs license had to have different licenses in our pocket from other states! I had 3 and that was enough! That CO one was easy to get and the drivers test was fun!
But go ahead and call! You'll talk to an interesting person who just got a good laugh at your expence! Just remember if you don't read it in a real pamphlet, most of what you hear on the CB or around the counter in the truck stop or truckers bar is pretty much BS!

You only ever have to identify yourself and show your reg/proof of ins/dl to a cop. Beyond that, you don't have to say a word and you can refuse any kind of search. However, they can say they have probable cause and make something up and search. I always crack up when I watch "Cops" and the cop say he's pulling someone over because they just left a "known" drug house. I then say (to myself), then why don't you go to the "known" drug house and bust the occupants.

Hey, thanks for saving me a lot of typing. One of my childhood friends is a deputy US Marshal. I asked him about this several months ago. he told me it was pure crap. According to him this myth gets their office called at least 2 or 3 times a week. They just tell the trucker to hire an attorney and handle it that way. -
My dad told me he got stopped once and they asked if he minded if they searched the truck. He said sure but letting you know I have $1000 under my bunk and it better all be there when you're done. The guy smiled at him and told him to have a nice night.
