You might have a hard time convincing a cop of that story, just like you would trying to convince me. You can toss any "story" out that you wish but, your in that truck and you didn't see it, smell it or clean the #### truck? If wishes were horses, beggers would ride.

That's true, and we either have Constitutional (4th Amendment) protections or we don't.

The problem is there are items in the truck that can be inspected by the DOT. While this is rare it does happen. There really isn't a way out of a vechile search. If one refuses the LEO can detain you up to 72 hours while they get a warrant and/or do a background check. I had a DOT officer at the Banning Scales tell me the reason the majority of drivers get a ticket is because of their attuide. There are enough laws on the books that its virtually impossible to go thru the day without breaking some law.

Just that if one cannot refuse without being suspect and bringing wrath down upon himself, then you have no constitutional (4th Amendment) rights do you?

The same thing could be said if you buy a used car or pickup, and it has anything illegal in it.
Unless you search it _thoroughly_ first, anything the cops find illegal is YOURS, period. If you missed something, oh well, TOO BAD for you!
After you have given up you 4th amendment rights by telling the cops to search, you will be going to prison, since your lawyer will have nothing
to work with. The search will be quite legal, since you said YES to a search. -
And those legitimate items which can be inspected are not and does not constitute a search.
Not hardly. Where did you get this from. You may be confusing this with a vehicle inventory after an arrest or a search incident to arrest (very limited).
I don't know about the majority thing, but I agree that many drivers bring things on themselves because of attitude.
I have to agree with this also. For instance virtually no one doesn't speed if not just a little sometimes.

ultimately it's your word against a cops and saying no in a cops eyes means you're hiding something. so therefor you dont say no, simply ask why and whats the probable cause for the search. you can get out of a search but you gotta play the game and saying "no" doesnt cut it. please, go get pulled over and try it, you'll find yourself outside of the car.
