Fired from Werner over bad reference

    They may ask questions, but in most states, including MA, CT, NY, they employer being asked the question is not allowed to say anything other than you worked there, I know I went through a similar situation with my current employer..

    My husband finished driving school, which he paid for himself, in July 2007. He started with Werner and things were good. One of his three trainers was bad, but he just asked to be switched and they did. The dispatcher never got him home when he wanted to be home and then made him miss his Grandmothers funeral, so he quit Jan 2008. He then got a local job here with a company, but it wasn't much money so he went back to Werner May 2008, after applying online and put the local company down and that he had an accident which the police were not called for and no documentation was ever done on because there were no marks on the truck or the car. It was very minor. In July he got a call from compliance who fired him for not putting down the accident on the orientation papers, which he said he never filled out the 2nd hire time. They were looking at his first set of papers. He explained he put everything down online for this hire time. IT didn't matter, they didn't listen and fired him. He lost all his property except for the clothes he could fit in his duffle bag. His fridge, tv, pillows, sheets, blankets, big jacket, everything was left behind because he didn't have boxes to pack it in. He was stuck out in California! We live in Florida. I had to buy him a plane ticket to get home, which I had to make him wait in the airport for 16 hours for. They wouldn't even listen to my husband. And Werner keeps sending us postcards that they are family oriented and so glad he drives for them. He has been gone since July!

    Unfortunately after several weeks without work, my husband now is with Covenant and is so unhappy. Sat in TN for a week in the motel, then bus'd him to IN to pick up his POS truck that has no mattresses. Got him a load two days after that, only to find out the air comp was bad and he had no brakes. In the meantime of cleaning out the truck he found paperwork where the previous driver had requested brake repair. He was then broke down for 2 days until finally towed to the dealership, where he got sent toa hotel for 2 more days. He got a 80 mile load and now sitting another two days waiting. He wants to come home and I told him no because it takes too long to find another job. He doesn't have one year of drive time on his record, but he is talking to everyone he can about a job and looking online. Meanwhile he has no mattress, a disgusting truck covered in grime and grease, and lacking sleep.

    He would rather be back at Werner where they had a lot of miles and good trucks. He said Covenant has no upkeep of their trucks. Oh and get this, they say prayer over their class in orientation, but yet will put my husband into a truck with no darn brakes. Unreal!

    Ya Covenant is suppose to be owned by the Catholic church of all companies. Yes I did say a church owns them I was told by more than one source. Not saying it is true, but if it is it is sad indeed.. I would suggest your husband continues to search around, don't loose hope because someone will hire him.. Not the best but check out Swift as well, I have worked for them for a yr, and was happy, not a lot of miles mainly because I was new, and made my own mistakes along the way. I always had a nice truck, never had a issue getting things fixed. Always was home when requested.. I even kept the truck and trailer home for two weeks, when I went back to Ma for a funeral.. Left only because I found a local job..

    Part 393: Parts and Accessories Necessary for Safe Operation

    §393.76 Sleeper berths.

    Equipment. A sleeper berth must be properly equipped for sleeping. Its equipment must include:

    (e)(1) Adequate bedclothing and blankets; and
    (e)(2) Either:
    (e)(2)(i) Springs and a mattress; or
    (e)(2)(ii) An innerspring mattress; or
    (e)(2)(iii) A cellular rubber or flexible foam mattress at least four inches thick; or
    (e)(2)(iv) A mattress filled with a fluid and of sufficient thickness when filled to prevent "bottoming out" when occupied while the vehicle is in motion.

    If you're a mechanic with a CDL, a towing company might want to talk to you? It's not OTR but who cares. Heck,you'd be home most of the time.

    Werner can run their business as they see fit as far as I'm concerned, but if the trucking industry continues to treat drivers this way, someday I got to believe that these big companies will implode, either that or immigrants will be driving a large number of our trucks.

    They will i saw this crap happen in the UK & it will come back to haunt them ! ps. I'm an immigrant driver in Canada from the UK

    An FYI, when it comes to job references, especially when it didn't end so well, you can use people you worked with, clients and/or vendors...I too would suit the previous employer for slander and any monies you may owe Werner because of it...Be upfront with any new company you talk to and good luck!
