THE ONLY THING in the original post that makes any sense to me is 24MPH OVER!! Now I know I'm kinda new at this(according to the guys that taught me to driver--course they are all in there 80's LMAO)but you are complaining about a ticket for 24MPH OVER??? I've gotten a break or two in my life--but 24MPH OVER?? REALLY?? SERIOUSLY?? What the hell did you expect???A pat on the back???Sometimes you just gotta man up! Face it YOU F*****D up-sign your ticket--be thankful you only got one!! Then maybe start paying attention! oh yeah and stop whining!!

OK, I know these posts were questions to DB on what HE would have done. Since he has now answered, I'm also going to throw my two cents in here. I was never a DOT or HP. But I was a cop for over twenty years, both small town and rural county. While I never was terribly big on traffic enforcement, I did what I had to do, so take it for what it is worth.
Yet you are asking him to make a judgement call against a copper who WAS there, and had the information at hand. . .
Had you decided there was a problem with the ticket, you should have fought it in court, in a timely manner. I always encourage a person who believes they have received a ticket that was not deserved to do this.
The court has the ability to hear the officer's side of things, AND your side of things. They can take advantage of having much more information than you will ever be able to give, as the only info you can give is your POINT OF VIEW.
Trying to get another cop to say that it was a bad ticket, is putting him in a position of second guessing in a situation where he does NOT have all the facts. Only a very inexperienced and not very bright copper is going to fall into that trap.
As I said, the place to argue a ticket is IN THE COURTROOM. Not to the officer out beside the road, and not in a forum. (Not that there is anything WRONG with arguing it in the forum, it is just another topic of discussion. But it isn't gonna get you anywhere.)
That cop that makes the traffic stop has an awful lot of discretion as to what he does. With a few exceptions, it really is up to him as to whether he writes you or not.
Give him an attitude, and guess what decision he is gonna make. . .
And yes, from your statements about him being a rookie and an idiot, I'd be willing to bet that you gave him some attitude. Not a good idea, even if those descriptions are correct!jbatmick, formertaxidriver, Roadmedic and 4 others Thank this. -

hmm i am not sure--but if you are basically driving in an out of control truck---you would happy just to get a speeding ticket rather than careless driving or reckless endangerment -

I couldn't have said it better myself. First off, I wasn't there nor do I know what the road looks like or the signage. My opinion does not matter first off, I didn't write it. However, 24 mph over the limit is a guarenteed ticket from me everyday of the week. The part that sounds fishy to me is the Sgt. responded and ordered the rook not to write the ticket and he did it anyway. Don't know where this happended but I have never seen or even heard of a Sgt. showing up on a stop and questioning why I am writing someone a ticket. I must admit some things never seem to amaze me anymore. I had a local driver today that I stopped for not having a tag displayed on the truck or the trailer. While I walked up to the driver, I see he is on the phone. I overhear the following "Man, get up here." "I'm getting ready to go to jail, get up here. I'm in the truck you told me to drive. Where the h*ll is the registrations, because I didn't see any tags on either. Please come here. Well come bail me out. Please."
So after hearing this my first question was; "I take it you do not have a license? "Ah.........No. I'm suspended." Where's the tags? "I don't know. The guy I run for said to take the back roads and I should be able to avoid you."
Well, long story short the guy has no license, the truck and trailer have no insurance, tags or anything else it would need. The owner thought he was slick until I showed up at his house to say hello.dog-c, Hitman, bulldozerbert and 8 others Thank this.
