If you have a CDL, off duty, in your personal vehicle and you have to do the "blow test", is it .04 or .08 BAC? I say it's .04 and a co-worker says .08, who right? Thanks

I know for a fact based on first hand knowledge that Iowa bases the .04/.08 thing on the vehicle operated at the time, not the class of license held by the offender. I'm 90% certain that IN, IL, and MO are the same as Iowa on this.

.04 is when operating a commercial motor vehicle, 26,001 lbs or more power unit, combination weight 26,001 lbs or more when towing a trailer that weighs 10,0001 lbs or more, operating a vehicle designed to carrying 15 or more people including the driver, and/or operating a vehicle required to placarded by carrying the required amount of Table 1 or Table 2 Hazardous Materials chart.
I can't speak for every State, but that's they way it is where I work. .08 is for anything other than what is described above. You can be a .o6 a still get a DUI. Heck you can be .00 and get a DUI, if your under the influence of drugs/prescription drugs. You'll probably have to check with your State to be specific. -
I know a guy that started driving a pumpkin truck. He went through their school and got his CDL. After about 6 months he took a little time off and went fishing on the river. He was floating down the river in a canoe fishing and having a few cold ones. The game warden stopped him and gave him a DUI (because he was the only one that was still in the canoe that meant he was operating it) He lost his CDL and his job and had to pay schneider back for the schooling and his CDL because he did not work a full year with them.

ZERO tolerance with having a CDL. Even if u were on a boat, lawn mower, horseback, moped, bike, and even drunk in public.
U I'm afraid have lost ur CDL for good. U can still drive a car, But No big truck.
Thats why i NEVER have a beer out here on the road.
