What kind of "force" do they apply? Is it the guy in the sleeper with the gun pointed at your head? How does anybody "force" you to do anything?.. Does your longbook say "I certify that all these entries are true and correct"? When you sign your name there, you do so under the penalty of pejury,being that it is a legal and binding document, that can save your arse or put your asre in jail for a very long time..... NOBOBY tells me how to fill out MY log book from a cubicle 400 miles away.....

 

if you really log 5 and a half hours on line 4 WOW is all I can say

 

are you actually loading the trailer yourself?--or are you sitting around talking/sleeping eating ?
unless you are actually loading the stuff then you are only on duty 15 min--hit the door and sign in
yes the 5 1/2 hours will cut into your 14 hr day--but not your 70

 

all time spent at a shipper, waiting to be loaded is on duty not driving.. 395.2 (5)

 

It includes the following activities:

• All time at a plant, terminal, or other facility of a motor carrier or shipper, unless you have been relieved from duty by the motor carrier;
• All time inspecting or servicing your truck, including fueling it and washing it;
• All driving time;
• All other time in a truck unless you are resting in a sleeper berth;
• All time loading, unloading, supervising, or attending your truck; or handling paperwork for shipments;
• All time taking care of your truck when it is broken down;
• All time spent providing a breath, saliva, or urine sample for drug/alcohol testing, including travel to and from the collection site;
• All time spent doing any other work for a motor carrier, including giving or receiving training and driving a company car; and
• All time spent doing paid work for anyone who is not a motor carrier, such as a part-time job at a local restaurant.

The bottom line is that on-duty time includes all time you are working for a motor carrier, whether paid or not, and all time you are doing paid work for anyone else.
The definition of on-duty time is found in Section 395.2.

 

Not if i get in the sleeper!! But by all means please waste your 70 hour clock waiting

 

thats true you can log sleeper birth,but you must be in it... No falsifing your book to not "waste your 70".... So if i see you walking around the dock to get your bills and it has a time stamped on it, 2 hours after you got there,and you show that you were in the sleeper, I got your ### for a violation... pay me !!!!

It is obvious there are still many out there who have not discovered that according to the rules of service you are not allowed to be in your sleeper once your truck has backed to the loading dock. Now I agree with, and am all for doing the sleeper berth or on duty not driving at this time, but let's face it "ImaLostCause" has a valid point on the logbook issues with that carrier. If you change one thing you will inevitably have to start changing more as it follows. Why can't we just agree that it has become a dead end situation. If you have paid any attention to just a few of the new rules, you will at least know that eventually you will wind up being cited for a logbook violation. Why you ask? For one because with the new CSA B.S. we now have the probability of being compliance audited. this my friends will entail having all the load records matched to fuel and toll receipts, broker dispatch receipts, loading receipts, logbooks, etc.... NOTICE if you will that a lot more shippers are putting if not the times of loading and unloading the date with an A.M. or P.M. adjacent to it. Be forewarned.
