And thanks for the threads. I really did (and do with other posts) try and find the answers first. Guess I will have to try harder next time since it is a pain in the ### for people to be answering the same old posts every other day.
As for the other posters who chimed in with helpful answers, yup I agree with you.
I figured that when a 34 hour reset took place or otherwise knew for certain I was not driving till next day maybe a beer is in my immediate future. Even off duty, not in or around the truck as that is just not kosher. I just wanted to know how "normal" people did things in the "real" world while staying smart and safe. -
The question to ask before popping the top is.......... Do I REALLY need to drink this? I mean do you really, really need to drink an alcoholic beverage while sitting in the truck or while not at home? REALLY? Is it that life threatening that you go without until you are at home so that when the company that you might have signed a copy of the company rules that said that there is NO alcohol allowed in the truck or consumed while on the truck meaning while the truck is away from the terminal or your residence and they call and you have to tell them I can't drive because I just finished a beer or a 6er.
That is a sure way to having to clean out the truck and find a way home OR you can lie to them and start the truck up and take the dispatch they give you and as you are driving Murphys Law kicks in and you have an accident and either really hurt someone or kill some one but being in a law suit target called a big truck, you wind up in jail, get a DUI, pay a ton of money on a lawyer, the court system then a lawyer again for the multi million dollar law suit you get to be in with your company! I know you watch TV and have seen the ads these ambulance chasers have on!
Yeah, unless you can be certain that you will not have to get behind the wheel of a truck untill you are completely certain that there is NO percentage of BAC then you can wait to drink a stupid alcoholic beverage! if you can't wait then you just might have a problem and we both know what that is and it requires a little work to get over!
Another problem many of you don't understand is if you are drinking a beer in the truck and a cop walks up it does NOT matter if the key is in the ignition! You CAN be arrested for DUI or an open container law in a lot of towns, counties and states! They can even pull you out of your car/truck in the bar parking lot when you are passed out even if the car/truck isn't running because in either one you have the ability to drive it! The BS some or a lot of drivers say that the truck is their home doesn't stand up in a court of law! It's a CMV and thus open to any law that oversees driving.
I have watched cops follow a driver from a truck stop bar to his truck and wait for them to sit in the drivers seat and then pull them out and do a sobriety test and then haul them away and the truck also! The TA in Wheeling was notorious for this as was that dump at the Pilot at exit 4 in Indy! Even the old All American in Carlisle too IF the cops could keep the guy in sight before he made it through the fence to the parking lot and disappear! I could name a few more but why the point is made. You spent a ton of money and time on that piece of plastic in your wallet called a CDL with endorsements. Is it worth losing it for a cheap buzz while around that truck?
Yes, I too enjoy a GOOD beer and have when I had the time would enjoy a good import over this crap with a born on date! Hey, it's was a one time a week thing so why waste it on bad beer! But if I knew that I was not going to be doing anything till I knew I could blow a 0% there was no way I would drink anything! The federal standard for BAC in Canada is 0.08%. Over that and it is a criminal code offense (which is why Americans with a DUI conviction have a hard time entering Canada). Commercial vehicle drivers subject to National Safety Code (NSC) regulations with a BAC over 0.05% will net a suspension for a maximum of 24-hours (NSC for Motor Carriers: Standard 8 ).
Some provinces have enacted stricter legislation, but the sanctions are administrative only as provinces lack the authority to administer criminal violations. Nova Scotia, like most other provinces, has enacted legislation for all drivers (commercial and private) that effectively mimics NSC Standard 8. That is, a BAC over 0.05%, but less than 0.08% will result in some form of suspension and administrative fee. In Nova Scotia's case licence suspensions are seven days for a first suspension, 15 days for a second and 30 days for a third. Drivers will also be required to pay a licence reinstatement fee of $89.63 each time a suspension occurs.
Three exceptions of note:
- Saskatchewan's administrative sanction is effective at a BAC of 0.04%.
- The following provinces have a zero* tolerance for new drivers undergoing graduated licensing; Ontario, Quebec, Northwest Territories, Manitoba, Alberta, Saskatchewan, British Columbia, Nova Scotia and New Brunswick.
- Zero* tolerance applies to drivers under the age of 22 in Ontario.
*Zero doesn't mean "zero". It is accepted by the courts that a 0.02% margin of error exists (this also applies to FMCSA legislation in the U.S. as I noted in the threads linked by ronin).
Your company may have policies that are stricter than provincial or federal legislation. -
Since this subject is somewhat sensitive, and should be as it effects peoples' lives, let me make my original question absolutely CLEAR though I thought I did.
1) NEVER in or around truck and never having any containers in truck.
2) NEVER if you would be driving or operating truck (my personal limit would be the same as when I flew...at least 8 hours since drinking and never)
Somehow the question is one of those "blasphemous" questions that no matter how carefully worded still seems to send people off tangent, they never read the actual wording of the question, but instead see the word alcohol and go into (to use Ronin's word) a diatribe.
Frankly, I regret even bringing it up. And they say avoid politics, sex and religion in public conversations!

I believe its against the law to have an alcohol in the truck that is not part of the load. I personally only drink at home and when I have the following 24 hours off AFTER waking up, usually not feeling to well..lol
