I got scammed by an owner operator need advice!

    I actually did think about holding the truck hostage but I talked to my buddy who is a detective and he told me I could be charged with theft if the right prosecuting attorney got a hold of it. I can't afford bail :(

    And lots of chrome , no qualcmm, and loose leaf logs and small mom and pop operation.

    Too late now, if you don't or can't get to the truck....if you can, the correct way to get your $$$ is to get the truck, park it in secure storage, or on your property, go down to the court and file a "Mechanics Lien" on the vehicle (and trailer) claiming the $$ amount you are owed, plus court/attorney costs.

    By having the Lien on the vehicle you can't be charged with theft.

    Ah well she said she needed to hold my first check. That is pretty common with a new job so i didn't think much of it at the time. I sure do now though.

    yes it IS common to hold the first check, i'll give you that...

    but o/o's do not usually pay benefits, or taxes, you pay the taxes..now beware...she can mess with you and report to the IRS she did pay you on a 1099...!!! i had worked for an o/o, and every payday (fridays) i went to his house for my money, he didn't like that..well too bad..his other drivers were told, "when he gets paid from the broker, they will be paid".....i wasn't waiting, every friday i went there..?? he pulled out his checkbook....

    i wasn't about to not be paid for my time....this i did when i first started out as well...i was never burnt by the o/o i will admit, but what i DID LEARN was to NOT let them get away with BS stories about THEM WAITING to be paid.....i worked...?? i wanted my money.....and got it too.
