Is an owner operator responsible to pay for damages to company trailer?

    You would have no problem getting a judgement,your problem is collecting. Also your costs could run more than the judgement,even if you could collect.

    What does it cost to fix the axle, if it can be repaired $800-$1200. If it needs to be replaced $2000-$4000, how much is an attorny going to cost you?

    So you get a judgement then what, you still have a broken trailer that needs to be fixed.

    I just dont get everyones rush to call an attorney over small things maybe it is just me.

    It doesn't hurt to get a judgement,just don't get high hopes on collecting. Had one on a driver that was 3 1/2 years old,was contacted a few months ago to make payments on it. Came up on a home loan and had to be cleared.

    if he's leased to you he is covered under your insurance the only thing you might possibly get is the deductible.....but if you have nothing in your lease agreement best to chalk it up to experience and revise your lease agreements

    as far as dinging his dac for an accident that would put you right up there with the bottom feeders ....i doubt it was intentional just tell him you can't afford to keep him around


    anybody on here that says they have never curbed a trailer is full of crap.......

    Common in all states contract law,if a written contract exists(lease agreement) then there are no verbal addendums. Not spelled out,doesn't exist.

    WTF? You delete the entire post? So saying someone is an instructor at a CDL Mill is an insult? How so? Asking how many small trucking companies they've run is offensive? It's the truth. So if I just removed the You're an Idiot at the end it would've been acceptable right?
