I think its fairly clear that it applies only to a CMV operation not a private vehicle. I have no problem with it being .04 for operating any vehicle but that is not what the law you linked states. -
Personally, I think any level of alcohol in any vehicle, POV or CMV should be a DUI charge, and a permanent loss of license. NO SECOND CHANCES on alcohol violations.
Can't remember what country it is, somewhere in the middle east. Convicted of DUI, they just chop your head off. They only have about 1 DUI a year. Pretty strong deterrent! Wish they would do that here. Would probably save 1000s of lives in this country.
I don't drink, not even as a kid did I drink all that often. 1 drink I will not drive. 2 drinks I am off balance. BAC probably under .o4 at that point, but I honestly don't think I would pass a field sobriety test. of course that was 10 years ago and 70 lbs lighter. Haven't had so much as a beer since then. might be able to handle 3 beers now before getting off balance.Tazz Thanks this. -

Here is the section from the state of Ohio CDL manual that deals with this discussion. If someone can post another law, ruling, section, or specific case number that shows the state is or has prosecuted CDL holders in their personal non-CMV vehicle for blood alcohol levels mandated for the operation of CMV vehicles than do so.
1.2.2 - Alcohol, Leaving the Scene of an
Accident, and Commission of a Felony
It is illegal to operate a CMV if your blood alcohol
concentration (BAC) is .04 percent or more. If you
operate a CMV, you shall be deemed to have given
your consent to alcohol testing.
You will lose your CDL for at least one year for a first
offense for:
Driving a CMV if your blood alcohol concentration
is .04 percent or higher.
Driving a CMV under the influence of alcohol.
Refusing to undergo blood alcohol testing.
Driving a CMV while under the influence of a
controlled substance.
Leaving the scene of an accident.
Committing a felony involving the use of a CMV. -
Whoa... am I misunderstanding this? You got laid off if you'd been drinking? Well, of course you should, how is that unfair? -
Hell they were so strict....Your hair couldn't touch your collar when you looked up.....No piercings.....No tattoos that could be seen by the customers....The customers were utility companies and the oil companies..... -
That's about the same rules I'd have if I had a company...
