Meaning that if you go off duty to reach a safe haven then the next morning you have to drive back to that same spot before you can go on duty. This would mean no fueling up etc until you have reached that spot.
Meaning that if you pull over at yarsdstick 199 get off ramp and go off duty then driver 40 miles to the nearest TS that has parking then the next morning you have to drive back to yardstick 199 get off ramp before you can go back on duty, then drive to the TS and get fuel.
Also you better not be under load. ND dot says that even an empty trailer is considered being under load. -
Nonsense, Rat. If unladen and released from duty, the truck can be driven to "lodging." That could be a truck stop. There is nothing written anywhere that saus the driver has to return to where he was released from duty. I'm talking about OTR, not local. It would be ridiculous to be released from duty at the receiver, go to a truck stop 20 miles away and then return to the shipper to go back on duty.
And off duty driving may not be used while under a load. Period. Until FMCSA changes the rule, driving "off duty" to get to a safe haven, while under dispatch, is log falsification. The companies do not write the rules.Meltom, RickG and 07-379Pete Thank this. -

RM: Yes, as long as the driver does not cross state borders. As soon as he does, he is an interstate driver subject to FMCSR.
