Its part of the judicial branch's function to interpret the law as applied to specific instances. If the people and their representatives don't like the way the law is being applied, then they have the option of inititiating legislation that more suits their taste. -
The letter of the law is exactly that. Whether or not a person is in violation of the law is the black and white part.
The enforcement action (warning/citation/silver bracelets) is usually left up to officer discretion and may be based on circumstance. As for me, you are likely not going to get a citation for a clearance light out. But, you are likely not going to get a warning for a false log book.dieselbear Thanks this. -

I had an officer in a IL scale give me a verbal warning about 15 mins on my log book back in 05.
I logged 9:45 hrs off not 10. He could tell it was a mistake on my part probably caused by all the excitement of a Roehl driver hitting me in the parking lot as I was preparing to depart for the day myself.
Any way he handed me his pen and told me to fix it. (you have plenty of pages) I ran a loose leaf.
He turned around and watched traffic thru the big windows until he heard me crumple the bad page up. I handed his pen back. He said heres a trash can for that paper ball.
Told me to be more careful and to have a nice day.
None of my other pages had any problems so I'm sure he could tell it was an isolated incident.
I didn't try to falsify my log. It would have been pointless to write a ticket for that.volvodriver01, Injun and dieselbear Thank this. -
Was hauling a load of munitions from Camp Pendleton to Hawthorne, NV years ago.
Up 395. Just after I reached the point where it opens to four lanes and a very wide median, I saw a CHP officer running south, looking over at me.
I looked down and saw my speed...81mph!
I pulled over as he cut across the median and finally came up behind me.
First thing he said was, "Well, I want to thank you for not making me chase you clear to Bishop."
"No sense", I said. "I saw you, then looked down at my speedo and figured my goose was cooked."
He went and ran my license, came back and said, "moment of truth. How fast were you going?"
"I'm not sure. When I saw you, I hit my brakes and when I looked down, it read 81."
"close enough. I have you at 83."
He handed me back my paperwork and told me to slow down. If he caught me again, he'd throw the book.
And I slowed down!
Good thing he never asked to see my manifest!

Oh mine had cruise control. I was just in a go fast mood.
