    They don't.

The constitution is the supreme law of the land. Politicians have shredded the constitution to the point where folks such as yourself believe that BS laws and regs are over the constitution.

They did? Did they then have the load towed? Where did they take the load? Whom towed it? Was the towing company bonded? Whom did they contact about the seizure? Was the load HazMat or food grade? Hmmm?

    I find this really entertaining.

You actually believe that a scale house cannot take possession of a hazmat load?

The regs you are using are for the operation of the load on the highways.

It is no different that when you park a hazmat load and go inside to eat.

I do, and they cannot... Thank the Dept. of Homeland Security. It isn't any different then when we park an go in to eat, you're correct. That is the gov't for you, we are suppose to stay within visible sight of the vehicle.

In training, they used a scenario where terrorists put on cop clothes and were able the get the load. At least that is what we were told when they told us about it

Oh yeah, Port authoity captains can also legally seize a HazMAt load.

When I hauled general hazmat, there was NO WAY that I could keep the vehicle in sight. After all, if you stopped and went to the rest room, there are no windows.

The vehicle was also dropped at open location where we parked our trucks and others paid to park as well. When I left the truck, several hours later, someone would be picking it up to continue the load.

There is no rule that states you must be in sight. Also, the seizing and or parking at the scalehouse complies with the secure location and yes, they can take possession.

    Injun Thanks this.
