Because nowhere does it say they were prosecuted by the FMCSA. They were charged with "... conspiracy, making false statements, making false statements to a bank."
Can you tell me which section in the FMCSR they were violating? I am pretty sure that the FMCSR has no section pertaining to conspiracy or making false statements to a bank. But if you can show it to me I will admit that I am wrong.
They just happened to be doing something related (though loosely) to the FMCSR when they committed a crime. If you rob a bank wearing a NY Giants sweatshirt doesn't mean that you were doing anything for or against the Giants.
(No disparragement was intended towards NYG fans... Just used that example since they won the game...)
