Use to use my old truck to pull my 45 foot toyhauler to the sand dunes and moutains all the time never had a issue with any DOT or scales.

Unfortunately for you, you are incorrect about the need for the sleeper.
As of February 27, 2012, the driver could sit anywhere in the parked truck and be considered off duty. He can be sitting out of the truck as well.
Nowhere in the regulations does it say he has to be in the sleeper berth.
What are some of the examples of the abuse of personal conveyance you saw? -
I think what the driver tried to do was count the first hour at the scale off duty when he was being inspected,which would have been on duty. So his 8hrs would have only been 7hrs off. I thought the new rules did not go enaffect till 2013 if I understood it right.

One small part is in effect 2/27/12. It is the sleeper berth section. My comment has nothing to do with the hour. It is only aimed at the requirement of the scalemaster for SLEEPER BERTH.

But, after 7 hours, he would only need 3 hours of off duty or sleeper, not Sleeper as stated. -
The law states "must be 8 contineous hours in the sleeper berth". No off duty time can be counted towards the 8 hour portion of the sleeper berth split break.

But, you think he still needs 8 hours continuous in the sleeper berth after spending 7 hours there?
Why not just another 3 hours and then he has satisfied 10 hours off duty or in sleeper? -
I am fully aware of the change in the definition of ON-DUTY. I have always considered Off-duty time as time the driver can do anything or be anywhere he wants to be. I don't have to wait until 2013 for that.
My driver needed 8 hrs in the SLEEPER to count as the 8 hr sleeper portion of the split. He could be anywhere and call it Off-duty, but then he would have to stay 10 hours. I always calculate the SOONEST that a driver gets back hours available to drive, trying to help him out.
And yes, he must be in the sleeper to call it line 2, sleeper berth on his log.
