Just some of the stupid things I see

    Question 26: If a driver is permitted to use a Commercial Motor Vehicle (CMV) for personal reasons, how must the driving time be recorded?
    Guidance: When a driver is relieved from work and all responsibility for performing work, time spent traveling from a driver’s home to his/her terminal (normal work reporting location), or from a driver’s terminal to his/her home, may be considered off-duty time. Similarly, time spent traveling short distances from a driver’s esn route lodgings (such as en route terminals or motels) to restaurants in the vicinity of such lodgings may be considered off-duty time. The type of conveyance used from the terminal to the driver’s home, from the driver’s home to the terminal, or to restaurants in the vicinity of en route lodgings would not alter the situation unless the vehicle is laden. A driver may not operate a laden CMV as a personal conveyance. The driver who uses a motor carrier’s Commercial Motor Vehicle (CMV) for transportation home, and is subsequently called by the employing carrier and is then dispatched from home, would be on-duty from the time the driver leaves home.

    Your pervious interpretation doesn't seem to include THIS... This seems to indicate that when I drop my last load, and have no new load(unladen). I am off duty.

    I get that. I shouldn't have to argue it, though. It should be laid out clearly so I don't have to defend myself from someone's random interpretation of it. They can't even figure out what laden means.

    what is the problem with understanding laden or unladen?

    laden means with a load
    unladen is without a load

    some seem to think it means bobtail only

    but then i own my trailer also, what do i do leave it?? lol

    its not rocket science, if ya have a load , drop your trailer, and bobtail to eat, you are ok with personal conveyance.

    the smart thing is to note the personal conveyance on your log, just flag from off duty at the time you start personal conveyance, and go about it.

    here is a hint about the word "laden" it is the reason you have a "bill of lading" , you know the papers you get when you pick up a load.



    that way if you get stopped, it is there , and it will be clear on your log.

    Yeah, anyone with some sense can tell what it means. Unfortunately, there are some officers who will write you tickets for dragging an empty trailer around even though it's obviously not laden. And with a few thousand local cops who have no clue what they're doing getting in on this, it really needs to be laid out so there's no question in the rules.

    There will always be questions about some rules and with rules of employment to avoid even dealing with those rules, like split breaks.

    I haven't had to bobtail much lately.

    What is it with people and their cell phones? Happens every day, time after time....

    I call a guy in the scalehouse to let him know he has a light out, or a flat tire, or something. He comes in with his bluetooth stuck in his ear, talking to someone else while he is talking to me. I don't know at any given time which of us he is trying to talk to, so I quit trying to engage him in conversation and decide to wait patiently until he is done with his other conversation. I mean, it is only polite, right?

    :biggrin_25516:Guy gets all pissy that I won't get on with it and talk to him. I politely tell him that when he is done with his phone call, I will be glad to talk to him. After a few choice words with his other conversation he hangs up, and I finally have his undivided attention.

    Good grief! I only need to interrupt his conversation for a few minutes, then he can call them right back.

    What used to be considered quite rude is now commonplace.

    Please people -
    Hang up and drive
    Hang up and shop for your groceries
    Hang up at the checkout counter
    Hang up when in conversation with another live person
    Hang up and live!

    That's why I refuse to get one of those earpieces. I have a big, clunky Droid X2 and the next phone I get will be even bigger. If they start making big old brick phones again, I'll get one of those. I do not answer the phone if I'm busy with something else, and usually don't answer the phone at all. There's this nifty thing called "voicemail." Use it. Or go bother someone else.

    Also, phones and faxes do not fix everything and do not remove you from needing to be responsible.

    During a DOT inspection, when I am asking you questions and looking for paperwork, don't dial your phone and hand it to me and say "Here! Talk to my boss". I don't need or want to talk to your boss. I am talking to you! You talk to your boss if you need to, he is your boss.

    And if we are missing paperwork or if you have an expired registration or medical card or something, why is the first thing out of a driver's mouth "What is your fax number?"

    First of all, I don't have a fax machine. No room for it in this chicken coop.

    Second, any enforcement action taken here is based on the way you came into the scale, not the way you go out. If you did not have it when you came in, then you did not have it.
