    Sorry to hear of the injury and loss of the truck, but drivers all need to learn to not overdrive their headlights!

    If the events ocurred as the OP states they did, sounds like they've got at least some defense here. Every similar situation will still have their differences, however seemingly minute.

    A good attorney would quickly get to the bottom of it.

    All I can say is.. try to install HID in a company truck..and see how fast you dont have a job..lol .. Drive only as fast as your lights allow.. ? states have a min speed limit.. driving below minimum limit will get you a ticket..but slow down..use your flashers if you have to...
    I have had something similar happen.. but I hit the ditch.. almost rolled the truck..yea you have 10min to put out triangles..but if your on a dark road..and stop in the middle of it.. you better have your four ways on or set up triangles..as fast as you can...if not imho..your a dumb ars... you cant always go by the book.. you have to use common sense lol..

    Isn't it funny how 90% of the criticizing posts in this thread come from people listing student, newbie less then one year, or wannaby.

    One thing that has helped me avoid road hazards is a good CB. I just can't understand how someone can drive at night without one.

    Nothing trumps safety. If you are below the minimum, use your 4-ways.

    Go slow, get the ticket, go to court, bring pics of accidents like those in this thread. The judge will be chastising the LEO in front of you for harassing the safest truck driver the judge has ever met!

    I have no issue with people making mistakes and owning up to their shortcomings, but if you honestly think an accident as described in OP is unavoidable, you're bound to rack up incidents. Or as my grandfather used to preach: "you don't reach 2 million safe miles by accident"

    Not criticizing you, OP, or maybe I am but 500k miles in 15 years? Not really much, I know 4 wheelers that will do that much commuting to work in 15 years. Ok fine maybe he doesn't know exact miles, but in litigation he #### sure better find out. I guarantee the other side knows how many miles. Good luck to you

    Some of you guys sound just like the safety director at your company you detest so much. It is real easy to say it should never have happened. But when you have an accident some day, you will want and expect a little bit of the sympathy and understanding you refuse other people. And when your safety guys call your accident "preventable" you will feel wronged as well. Sometimes it isn't totally necessary to be a hard-a.s.
