Police Department doesn't issue accident report??

    I'm in the process of getting into a CDL program.
    I contacted the recruiter today, and everything looks good; background, employment, etc. However, I had an accident (not at fault) from January 2009 in Yonkers, NY driving my own vehicle. The recruiter told me I needed to get an accident report. After finally getting through to records division, I was told that the Yonkers PD does NOT issue an accident report if: a) no one was injured AND b) the vehicles are able to be driven away, not towed.

    WHAT?? I have NEVER heard of this before! I don't know what to do. I cannot produce a viable piece of paper if none ever existed! I asked, of course, if I could fill one out now (half-jokingly) and of course too much time has passed, and again, they don't fill them out.
    Any suggestions out there?

    Since it was in your own vehicle and there was no report filled out and you didn't receive a citation. This will not be on your records showing anything or anywhere. get a copy of your dmv record to check but Im betting it won't be on there.

    I did pull a MVR, and it does show up (they go back 10 years). I was not ticketed (however the other....let's just say, nepotism may have played a factor).
    It doesn't make any sense what so ever.

    Was insurance involved? If so could they have a report on hand, possibly?

    Good idea....I didn't have comp/collision at the time, although I wanted to go after the other driver for the damage. No claim was made against me, and vice-versa.

    I can't speak for Yonkers, NY, but here in NC if the damage is less than $1000, no personal injury, and if the parties involved decide to settle it amongst themselves, then no report would be filed. The only way it would show up on your DMV report was if a report was filed. DMV pulls the information for their records from the police reports.

    I would take a copy of the DMV to the police department and ask to speak to a supervisor and show them the report. If you should happen to know the officer's name you could try and locate him/her.

    Actually, now that you say that, I believe that is the same for NY. And dealing with Yonkers...ugh. The lady was nice enough to look it all up for me. She didn't want to and started to ramble on how I had to do this-that-and-the-other...It does give me suggestions and things I can go on. Back to Google and see if I can pull the statute as proof and be done with this. Thanks!

    (still confused as to why it would show up on MVR...strange....)

    If there was never a report made, then it is impossible for them to give you a copy of it. Obviously. And to try to get a report now, this long after the fact? Ain't gonna happen. For one thing, they will not just take your word for what happened, and there is no way that the responding cop is going to remember anything about it. Or at least not enough to write a report about it.

    Same thing with insurance. If a report was never generated by a law enforcement agency, they couldn't get a copy, because one does not exist.

    FWIW, there are some agencies that will not make an accident report if there are no injuries, and the damage doesn't meet there criteria for a report. But sometimes these agencies will let you go to their headquarters and fill out what is called a "Counter Report." It isn't much, but it does give you something for your insurance company. However, I can't believe they would allow you to do this with a huge time separation between the incident and the time you want to make the report.

    I'm afraid you are going to be stuck with trying to convince whoever "needs" this report, that it is not possible for you to get it. Good luck with that.

    Now just as an after thought here, if you can't get any satisfaction from the recruiter, could you talk with a supervisor there?

    well, I did find the form on the DMV website, a "MV-104" I believe. It clearly states that any accident with OVER $1,000 property damage, and/or injuries a report MUST be filled out. Mine did not fall into any of that criteria.
    The lady was at fault; made an illegal turn in front of me and I hit her. Probably why she did not go after me or my insurance to get her damage taken care of. Plus, I took many, many pictures of the scene to cover my butt. Now, I realize nothing came of it, but I am asked to "produce". It appears that this "law" is not well known. Sheesh...I didn't even know...LOL
    I know I will be able to clear it up. Blue_Knight knocked some of the cob-webs out of my head, so I am sure I will have no problem going forward. If need be, I will talk to a supervisor. I'm a gal who knows how to get things done! And thanks to all of you for your help.
